Resolution 1992-226 RESOLUTION 92--226 APRIL 14. 1992 RELATING TO PETITION NO. PU-89-18 FOR EXTENSION OF CONDITIONAL USE OF PROPERTY HEREINAFTER DESCRIBED IN COLLIER COUNTY, FLORIDA WHEREAS, the Leqislature of the State of Florida in Chapter . 125, Florida Statutes, has conferred on all Counties in Florida the power to establish, coordinate and enforce zoning and such business requlations as are necessary t.or the protection of the public; and WHEREAS, the County pu~suant thereto has adopted a Land Development Code (Ordinance No. 91-102) which establishes comprehensive zoninq requlations for the zoninq of partiCUlar divisions of the County, among which is the qranting and extending the time periOd of Conditional Uses formerly known as Provisional Uses; and WHEREAS, on June 19, 1990, the Board of County Commissioners enacted Resolution No. 90-336, attached hereto and incorporated herein, which qranted a provisional use now known as a conditional use pursuant to Ordinance No. 91-102, for a marina and private club, on the below described property; and WHEREAS, on June 11 , 1991 the Board of County Commissioners enacted Resolution No. 91-453, attached hereto and incorporated herein which qranted a one (1) year extension to the Provisional Use qranted in Resolution No. 90-336; WlIEREAS, SUbsection 2.7.4.5 of the Land Development Code provides that the Board of Zoninq Appeals may extend the one (1) year time period for a conditional use which has not been commenced; NOW, THEREFORE BE IT RESOLVED, by the Board of Zoninq Appeals ef Collier County, Florida that the written request of James A. Davis of Coastal Enqineerinq Consultants, Incorporated representinq Tempustech, Inc. for the second of three (3) permitted one (1) year extensions, in interest of the following described property: See attached leqal description Exhibit "A" -1- _ nnn "',..
