WHEREAS, the Board finds it to be appropriate and necessary to amend the legal description of the North Naples Roadway Municipal Service Taxing and Benefit Unit by amending Exhibit "A" to Collier County Ordinance No. 86-40; and h"dEREAS, ths purpose of such amendment is to include additional lands lying within Sections 18 and 19, Township 48 South, Range 26 East. NOW, THEREFORE, BE IT ORDAINED BY THE BoArD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: Smction One. Amendment to Exhibit "A" of Collier County Ordinance No. 86-40 Exhibit "A" of Collier County Ordinance No. 86-40, which legally describes those lands within the North Naplms Roadway M~nicipal Servics Taxing and Benefit Unit, is hereby amended as s.t forth in amended Exhibit "A" attacked hereto, to include additional lands lying within Sections 18 and 19, Township 48 South, Rangm 26 East, Collier County, Florida. Section Two. S.verabi lity If any phras, or portion of this Ordinancm iq hmld invalid or unconstitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. Section Three. Declaration of Emergency This Board does hereby declare that an emergency exists and that immediate enactment of this ordinance is necessary, ,and by no less than four-fifths (4/Sths) vote of the membership of the Board does hereby waive notice of intent to consider this ordinance. Effective Date A certified copy of this ordinance, as enacted, shall be filed by the Clerk of the Board with the Department of State of the State of Florida, as soon after enactment as is practicable by depositing the same with the postal authorities of the government of the United States for special delivery by registered mail, postage prepaid, to the Florida Department of State. This ordinance shall become effective as provided in Section 125.66(3), Florida Statutes.
