and
WHEREAS, Section 112.215, Florida Statutes, authorizes
counties to enter into deferred compensation programs for their
officials and employees; and
WHEREAS, such programs offer certain tax benefits to
participants and thereby encourage voluntary contributions,
designed to supplement County retirement and Social Security,
with the goal of easing future financial obligations; and
WHEREAS, the International City Management Association
"Retirement Corporation" (ICMA "RC") represents that it meets all
legally qualifying requirements of the Internal Revenue Code,
Section 457, as amended; and
WHEREAS, implementation and administration of this
additional plan imposes no major cost upon the County, other than
the incidental expenses of disbursing employee deferrals and
other minor administrative matters; and
WHEREAS, by the adoption of the ICMA "RC" Program, all
regulatory, operational, administrative, and fiduciary
responsibilities are hereby assumed by ICMA "RC"; and
WHEREAS, ICMA "RC" has agreed to hold harmless and indemnify
the County, its appointed and elected officers and participating
employees from any loss resulting frc.n the ICMA "RC" or its
agent's failure to perform its duties and services pursuant to
the Trust Agreement.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUN~f
COMMISSIONERS OF COLLIER COUNTer, FLORIDA, that:
SECTION ONE.
Section 1 of Collier County Ordinance No. 83-25 is hereby
amended to read as follows:
Section 1. Deferred Compensation Program~
A. The Board of County Commissioners of Collier
County, Florida, hereby adopts the National Association of
Counties {NACo) Deferred Compensation Program and the
International City Management Association "Retirement
Corporation" {ICMA "RC") Program and hereby establishes for
itself the Collier County, Florida, Deferred Compensation
Plan for the voluntary participation of all eligible County
officials and employees. The Program "Deferred Comp(~nsation
Plan for Public Employees" and "Administrative Service
Agreement" documents are hereby incorporated into and made a
part of this Ordinance by this reference. Further, th__e
International City Management Association "Retirement
Corporation" Program, the Declaration of Trust of ICM_~A
Retirement Trust, the Trust Agreement With The ICMA
Retirement Corporation are hereby approved and
incorpoFated into and made a part of this ordinance
reference. A copy of these program documents will be made
available for public inspection at the office of the Clerk
to the Board. The-Prog=am ~s These Procrams are entered
into with the understanding that, other than the incidental
expenses of collecting and disbursing of the employees'
deferrals and other minor administrative matters, th~re will
be no cost or contribution by the County to the Program~.
B. The Board of County Co~unissioners of Collier
County, Florida, hereby designates the Public Employees
Benefit Services Corporation (PEBSCO) to administer the NACo
Deferred Compensation Program and the ICMA Retirement
Corporation to administer the ICMA"RC" Deferred
Compensation Program on behalf of Collier County.

C. The Collier County Nanager or his desE~nabe
designee is hereby authorined to execute, on behalf of
Collier County, individual participation a~reamonts with
each employee requesting to participate in the
Deferred CcmDensation Proqrams.
SECTION TWO.
Section Two, Paragraph B of Collier County Ordinance No.
83-25 is h.)reby amended to read as follows:
B. Powers and Duties. The Deferred Compensation
Program CoMmittee shall have the following powers and
duties:
1. Review tho performance of tho NACo Deferred
Compensation Program and the ICMA "RC" Deferred
Compensation Program and the administrative
performance of PEBSCO and the ICMA "RC" and make
appropriate recommendations to the Board of County
Commissioners.
2. Review petitions by employees for advance
distribution of deferred compensation in cases of
unforeseen emergencies and make recommendations to
PEBSCO, and NACo and ICMA "RC".
3. Hake recommendations to the Board of County
Commissioners on other matters related to deferred
compensation. ..
SECTION THREE. Conflict and Severability
In the event this Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
Ordinance is held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.

SECTION FOUR. Effective Date
This Ordinance shall become effective upon receipt of notice
from the Secretary of State that this Ordinance has been filed
with the Secretary of State.
