WHEREAS, Alan D. Reynolds of Wilson, Miller, Barton, Soll& Peek, Inc., representing The Lone Oak, Ltd., petitioned the Board of County. Commissioners of Collier County to amend Ordinance 86-11 and; NOW, THEREFORE BE IT ORDAINED by the Board of County Commissioners of Collier County, Florida; SECTION ONE: Ordinance 86-11, Section V, Neighborhood Commercial Tract, Subsection 5.02, Permitted Uses and Structures, shall be amended to read as follows: 5.02 PERMITTED USES AND STRUCTURF~ No building or structure, or part thereof, shall be erected, altered, or used, or land or water used, in whole or in part, for other than the following: 1) Permitted Principal Uses and Structures: a) Automobile service stations without repairs. b) Baker shops - including baking only when incidental to retail sales from the premises; barber and beauty shops; bicycle sales and service. c) Child care centers, convenience stores. d) Delicatessens; drug stores; dry cleaning - collecting and delivering only. e) Food markets. f) Hardware stores. g) Ice cream shops. 265 h) Laundries - self service only. i) Meat markets, medical offices. PDA-89-2, Collier May 4, 1989. ~GREEMENT A1 Reynolds, as owner or authorized agent for Petition agree to the following stipulations requested by the County Planning Commission in their public hearing on ~.' a. Petitioner shall be subject to Ordinance 75-21 %. (or the tree/vegetation removal ordinance in ~ existence at the time or permitting), requiring I:/ the acquisition of a tree removal permit prior to any land clearing. A site clearing plan shall be submitted to Environmental Resource Management and the Community Development Division for their review and approval prior to any substantial work on. the site. This plan may be submitted in phases to coincide with the development schedule. The site clearing plan shall clearly depict how the final site layout incorporates retained native vegetation to the maximum extent possible and how roads, buildings, lakes, parking lots, and other facilities have been oriented to accommodate this goal. Ail exotic plants, as defined in the County Code, shall be removed during each phase of construction from development areas, open space areas, and preserve areas. Following site development a maintenance program shall be implemented to prevent reinvasion of the site by such exotic species.' This plan, which will describe control techn/ques and inspection intervals, shall be filed with and approved by Environmental Resource Management and the Community Development Division. If during the course of 'site clearing, excavation, or other constructional activities, an archaeological or historical site, artifact, or other indicator is discovered, all development at that location shall be immediately stopped and Environmental Resource Management notified. Development will be suspended for sufficient length of time to enable Environmental Resource Management or a designated consultant to assess the find and determine the proper course of de ee Re action in regard to its salvageability. Environmental Resource Management will respond to any such notification in a timely and efficient manner so as to provide only a minimal interruption to any constructional activities. The developer shall vegetate all artificial lake littoral zones, between the sod line and low water elevations, with a 45 % coverage of native submerged and emergent aquatic vegetation at all future lakes not yet developed. Detailed site drainage plans shall be submitted to Project Review Sarvices for review. No construction permits shall be issued unless and until approval of the proposed construction in accordance with the submitted plans is granted by Project Review Services. All other conditions of the original PUD still are in effect. Article XI, Section 17G: Street ~avement.W~dth~ - waive requirement for local roads to have two (2) twelve foot lanes and provide alternative of two (2) ten foot lanes minimum, providing the streets remain private. Article XI, Section 17G, appendix "D", ~ocal ~0ad Typical Sections - waive width requirement as outlined in Item "b" above. However, the pavement sections shall meet minimum County standards or equivalent. May include alternative materials and/or structurally equivalent pavement sections based of FDOT equivalence standards as outlined in FDOT "Roadway and Traffic Design Standards" Index No. 514. Article XI, Section 17K: ~everse. Curves: provided roads remain private. Within the Commercial Area, the fire mains will be required to be 8" and meet 750 GPM at 20 PSI. Outside turning radius on cul-de-sacs will be required to be 50' within the Commercial Area. Ail Road ways within the Commercial Area will be required to be 24' wide in this area. 2 The buildings are required to meet all building and fire codes. The submitted PUD Master Plan, constitutes the required PUD Development Plan. Development of the Neighborhood Commercial Tract shall be in accordance with the following: The division of the Neighborhood Commercial Tract into 3 or more parcels shall constitute a Commercial Subdivision; and therefore, require submittal and approval of preliminary and final subdivision plans in compliance with Ordinance 76-2, as amended. Site Development Plans shall be required for each platted lot prior to the issuance of a building permit. ,- Development of the Neighborhood Commercial Tract as a single parcel shall require submittal and approval of a preliminary and final Site Development Plan in compliance with .Section 10.5 as amended of the Zoning Ordinance.
