Resolution 1992-160 RESOLUTION NO. 92-~ ,l.~ . .. .... or: future collection; ~ f~r'~;'~:WHEREAs, there is and RESOLUTION OF COMMISSIONERS TO PROPOSED TAX. MARCH 3. 1992 THE COLLIER COUNTY BOARD OF SUPPORTING ATTACHED AMENDMENT LEGISLATION REGARDING TOURIST WHEREAS, the citizens of Collier County overwhelmingly by a 68' margin a tourist development tax to be Collier County; and WHEREAS, subject to the order of a circuit court approving the tax, monies in excess of $4.9 million were held in an interest-bearing account; and WHEREAs, an appellate court thereafter determined the tax levied pursuant to an invalidly enacted ordinance; WHEREAs, it is in the best interest of the citizens of County to resolve the issues surrounding the tourist tax. previously collected and to reinstate the tax presently before the Florida LegiSlature and Senate Bills which permit the County to retain the 'previously collected tourist tax proceeds if a second refer- the tax is approved, but which do not provide the proceeds tor a public pUrpose it the tax is and dratt language has been prepared which provides legally sufticient curative legislation which ratifies the of the previously collected .tax proceeds regardless of or disapproval of a new tax by refer~ndum; and WHEREAS, the proposed draft legiSlation, which is attached and made a part of this ReSOlution, is more beneficial to citizens of Collier County 'based on the actual cost the reduction in potential legal challenges and the ot the tourist tax proceeds collected pursuant to a approved overwhelmi~gly by the voters. NOW THEREFORE, BE IT RESOLVED BY THE' BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: 1. The Board of County Commissioners recognizes its ~4.re~ponsibility to the citizens of Collier County to resolve the ">1f{"'" ' . MARCH 3. 1992 tourist tax issues in the most equitable, cost effective and ",~ime efficient manner. <:-',v.: ,Saetion2. The Board of County Commissioners strongly urges Legislative Delegation representing Collier County Florida f;;';c:~, and the Legislature generally to amend House Bills #147, #1551 >:.. ';'\ and #1967 and Senate Bill #2178 to include language similar in ~' ':l~~:, ; "~intent to the proposed House Amendment attached hereto. :/ "~~Section 3. The Board of County Commissioners does hereby ~,aupport and endorse legislation which provides for the use of j:previously collected tourist development taxes for the purposes authorized in another such tax levied pursuant to Section , 125.0104, Florida Statutes, which tax is approved by a majority of the electors votinq in a referendum or, in the event referendwa fails, the use of such previously collected in accordance with the purposes authorized in the initial ordinance. . 4.
