A RESOLUTION TO PROVIDE NOTIFICATION TO
THOSE RESIDENTIAL PROPERTIES LYING EITHER
TOTALLY OR PARTIALLY WITHIN THE AIRPORT
NOISE ZOIlE PURSUANT TO ORDINANCE NO.
91-40.

WHEREAS, on May 22, 1991, the Board of County Commissioners
adopted Ordinance 91-40 which amended Section 9.9 of the Collier
County Zoning Ordinance by adding a new Subsection 9.9 d., Naples
MUnIcipal Airport Noise Zones, Land Use Restrictions, Sound Level
Requirements (SLR) for Buildings and Structures, and SLR Design
Requirements, later codified by the Collier County Land
Development Code, adopted October 30, 1991, as Section 2.2.23,
Airport OVerlay District (APO): Special Requlations For Specified
Areas in and Around the Airports in Collier County; and
WHEREAS, Ordinance Number 91-40 identifies the 75 Ldn, 70 Ldn
and 65 Ldn contours, as established in the Naples Airport Part 150
Study approved by the Federal Aviation Authority, as the Airport
Noise Zones and sets forth soundproofing requirements for
residential development lying either totally or partially within
the Airport Noise Zones; and
WHEREAS, soundproofing is required for residential properties
located within the established noise zones through the use of
building materials which meet the required Sound Transmission
Cla~s Ratings specified in Appendix rv of said Ordinance Number
91-40. Appendix rv of said Ordinance Number 91-40 complies with
COllier County Building Codes and is not intended to impose an
extensive increase in construction costs; and
WHEREAS, said Ordinance Number 91-40 provides that
notification of potential noise imp~ct be recorded in the Official
Public Records of Collier County, Florida to provide notice to
pre.ent and future owners of residential properties: and
WHEREAS, upon completion of any future Part 150 Study or
Airport Noise Study for the other airports in Collier County or
the revision of the Naples Airport Part 150 Study, this Resolution
shall be amended to reflect the changes in noise contours as
approved by the Federal Aviation Administration (FAA).

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that:
1. Exhibit A of this Resolution contains Collier County
Zoning Maps numbered 9525S, 95278, 9534N, 95348, 9535N, 9536N,
9536S, 050lN, 05018, 05028 and any revisions or reconfiqurations
thereof depicting noise impacted areas and legal descriptions of
the Airport Noise Zone Contours.
2. This ReSOlution i. hereby direct~d to be recorded in the
Official. Public Records of Collier County, Florida to serve as
official notice of potential noise impact to owners of residential
propertiea located partially or entirely within the noise impacted
