Resolution 1992-139 FEB , 8 1992 RESOIDnON HO. 92- .JJ9 , RELATING TO PETITION PDPO-91-4 FOR A VARIANCE PROM THE MINIMUM BASB FLOOD ELEVATION REQUIRED BY THE FLOOD DAMAGE PREVEH'l'ION ORDINANCE (ORD. HO. 87-80) AS INCORPORA'l'BD BY REFERENCE IN'l'O THE COLLIER COUNTY LAND DEVELOPMENT CODE (ORD. NO. 91-102). WHEREAS, the petitioner Jue. McKinney, Jr., desires to place a new modular home and buld a Florida Room and carport "'J , located at 618 Sunset Drive acre particularily described as Block B, ~land Isles, First Addition Subdiv., Plat ~'" BoOk 8, Page 2, accordinq to Plat thereof, recorded in the '~'!/:<~~~:t:'~,,;:, ," ~4'~lic Recorda of Collier County, Florida at an elevation of 'J~'-~' i8.27 feet (NGVD) and bas requested a variance from the . . Kinillma sase Plooc1 Elevation required by ordinance Number 87-80 aa incorporated by reference into the Collier County Land Development Code (ordinance Ho. 91-102); and 'c. .:' . WHEREAS, the Board of Zoninq Appeals bas held a public hearing aa required by law; baa reviewed Petition PDPO-91-4 in accordance with SUbsections 18(5), (6) and (7), ordinance . lImIber 87-80 and haa ltade a finding that the granting of this . . petition complies with the intent and purpose of ordinance .... (1) The i2. 73 foot redu~ion f.J'.'ma the Plood Insurance Rate Map (PIRM) 11 feet National Geodetic Vertical Datum (NGVD) requirement t2 i8.27 National GeOdetic Vertical Datum (NGVD) is the minimua variance necessary, considering the flood hazard, to afford relief. (2) In passing upon this variance, the Board of Zoning Appeals has considered all technical evaluations fEB 1 8 1992 provided to it, all relevant factors, the standards specified in Ordinance No. 87-80, especially those contained in Subsections 18 (7) (a-n). NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING ,APPEALS OF COLLIER COUNTY, FLORIDA, that Petition FDPO-91-4 is hereby granted subject to the following conditions: 1. The variance shall be fo+ the reduction of the Minimum Base Flood Elevation required by Ordinance No. 87-S0 ~ 11 feet NGVD tQ tS.27.feet NGVD. , 2. The Chief Administrative Official shall mail a copy of this ReSOlution to the petitioner by certified mail return receipt requested and such mailing sh~ll constitute compliance with Section 18, (10) of Ordinance No. 87-80. The granting of this variance by the Board of Zoning Appeals does not make or imply any assurances that the subject property or structures are not subject to flood damages. The granting of this variance shall not create liability on the part of Collier County or by any officer or smployee thereof for any flood damages that result from reliance on this variance or any administrative decision lawfully made thereunder. 5.' In accepting this variance, the petitioner assumes all responsibility for any property damage resulting from its application. The granting of this variance has been predicated principally on the engineering data and information provided by the Petitioner and a review of same with respect to the considerations required by Ordinance No. 87-80. BE IT RESOLVED that this Resolution relating to Petition Number FDPO-91-4 be recorded in 'the minutes of this Board.
