A RESOLUTION REQUESTING THE DEPARTMENT OF
NATURAL RESOURCES, DIVISION OF MARINE
RESOURCES, STATE OF FLORIDA, TO ADOPT THE
DESIGNATED AREAS stJRROUNOING THE WIGGINS
PASS WATERWAY AS NO WAKE . - IDLE SPEED
ONLY ZONES FOR THE PURPOSE OF REGULATING
BOAT SPEEDS.
WHEREAs, the Board of County COlII1llissioners of Collier
. County, Florida, (hereinafter RBoardR) adopted Collier County
Ordinance Ho. 79-8, for the purpose of promoting safety in
the operation of vessels on waterways within Collier County,
and to prevent injuries and property damage caused by the
excessive speed and wake of such vessels; and
WHEREAS, said ordinance provides that the Board may, by
resolution, adopt at a PUblic hearing upon at least fifteen
(15) days notice of such hearing PUblished in a newspaper of
general circulation in Collier County, Florida, a request
that the State Department of Natural Resources review certain
waterway areas and assess the needs for boating restrictions;
and
WHEREAs, the Board finds that the establishment of "No
Wake - Idle Speed OnlyR zones is warranted in certain
navigable waterways and heavily traveled channels as
described herein to reduce reported boat and property damage
. resulting from excessive bo~t speeds and to prevent possible
injuries; and
WHEREAS, the Board further finds that the County should
request that the legally appropriate State agencies consider
the establishment of the RNo Wake - Idle Speed Only" zones
recOlll1llended by the County and approve and authorize Collier
County to place regulatory markers within said zones; and
WHEREAS, the area described in Section 1 "a" through
1 "d" of this Resolution is a natural habitat area for
manatees, frequent sightings of manatees have been noted, and
the State has aandated the creation of a Manatee Protection
Plan within the waterways of Collier County; and

WHEREAs, the PUblic hearing advertisement required by
'::~Collier County Ordinance No. 79-8 has been accomplished; and
WHEREAs, Section 327.46, Florida statutes, provides that
Plorida Deparbaent of Hatural Resource. shall have the
authority for esbblishing, by rule, restricted areas on the
of the State for any purpose deemed necessary for the
of the PUblic and that such restricted areas shall be
developed in consultation and coordination with the governing
of the county in which the restricted area is located;
WHEREAs, upon the establishment of the restricted areas
the Division of Marine Resources of the Department of
.atural Resources, Collier County will accept responsibility
for placement and aaintenance of regulatory a&rker.; and
WHEREAS, upon a duly advertised public hearing, and
having heard all testiaony presented, the Board finds that
the esbblishment of the herein described area. as RNo Wake _
Idle Speed OnlyR areas is necessary to promote and protect
safety and welfare of the citizens of Collier County and
. the Jlanatee habitat.
NOW, THEREFoRE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMHISSIOHBRS OF COLLIER COUH'l'Y, FLORIDA that:
1. The following described area. in Collier County are
hereby designated as "Ho Wake - Idle Speed Only" zones. "NO
MAKE - IDLE SPEED ONLY" signs shall be placed on pilings
located within the waterways a. described below and as
illustrated on Exhibit RAR attached hereto and made a part

a.
Wiggins Pass and Cocohatchee River:
'!'he
channel area starting at the channel aarker NO.6 which
is about 700 feet east of the mouth of the Wiggins
Pass; thence, easterly along the Cocohatchee River 'for
about 4,000 feet to the end of the zone, said point
being at the northern bridge on Vanderbilt Drive.

b. Wiggins Pass Marina Basin Channel: Commencing
at the northern bridge on Vanderbilt Drive; thence,
westerly along the Cocohatchee River for about 1,400
feet to the intersection with the Wiggins Pass Marina
Basin Channel, said intersection being the Point of
'Beginning; thence, northerly along the Wiggins Pass
Marina Basin Channel for about 1,000 feet to a bend;
thence, continuing along said channel easterly for about
800 feet to the seawall of Conklin Point Park; and
including all canal waterways adjacent to the
Westinghouse and Conklin Point Park properties.
c. Horse Creek: '!'he area starting at the
southern bridge on Vanderbilt Drive; thence,
southwesterly along Horse Creek for about 600 feet to a
bend; thence, continuing along said creek northerly for
about 800 feet to the intersection with the Cocohatchee
River.
d. Vanderbilt Channel: The area starting at the
intersection with the Cocohatchee River; thence,
southerly along the Vanderbilt Channel for 600 feet,
said point being the end of the zone.
2. In accordance with Section 327.46, Florida
statutes, the State of Florida Department of Natural
Resources, Division of Marine Resources is hereby requested
to approve and authorize the designated "No Wake - Idle Speed
Only" areas set forth in this Resolution.
