BAY IKPROVDlENT DISTRICT RESOLUTION DATED KAY 20, 1987 BY ADOPTING THE CURRENT WATER, SEWER MID IRRIGATION RATE SCHEDULE APPLICABLE TO PROPERTIES WITHIN THE COLLIER COv~T{ WATER~SEWERDISTRICT fOR ALL PROPERTIES U>CATED wITHIn THE PELICAn BAY COMMUNITY. WHEREAS, the Board of County Commissioners of Collier County, Florida, adopted Resolution Po. 91-755 setting rorth the aonthly rates, fees and other charges ror all water and wastevater services provided within. the Pelican Bay Services Division serviceareaj and WHEREAS, the Board of Supervisors ot the Pelican Bay Inprove:ent District ("District") adopted a resolution on May 20, 1987 establishing rates, tees and other charges tor utility services provided by the District ("District ReSOlution"); and WHEREAS, the water, sever and irrigation tacilities trans- !erred to Collier County pursuant to the Plan or Dissolution tor the District were transterred to the Collier County Water- Sever District; and WHEREAS, the Collier County water-Sewer District continued to charge the rates set torth in Resolution No. 91-755 and the rates adopted by the District Resolution pursuant to the Plan ot Dissolution; and WHEREAS, the Plan or Dissolution provides that the County shall not blend, and thereby raise, the total rates or the residents or rate payers within what was heretofore the District relative to water, se'"er or irrigation rates until such time as comparable utility rates within the Collier County Water-Sever District and the areas previously served by the Pelican Bay Improvement District are generally on parity with each otherj and WHEREAS, the Board ot County c01IIlIIissioners amended the Plan ot Dissolution to remove the limitation pertaining to the blending ot water, sewer and irrigation ratesj and aooe fJO(j,l..l 60 AU6 1 5 ~ WHEREAS, this Resolution has been advertised ror a public hearing to bG held on August l5, 1994, in accordance with all laws and statutes ot the State ot florida. now THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIOHERS OF COLLIER COmITY, fLORIDA, AS THE GOVERNING BODY OF COLLIER COmrT{ MIDEX::"OFTICIO THE GOVERNnrG BOARD OF THE COLLIER COUlITY WATER-SEWER OISTRICT,that: 1. Resolution No. 91-755 is hereby superseded in its entirety. 2. The tonner Pelican Bay Improvement District Resolu- tion adopted on May 20, 1987 is hereby superseded in its entirety. 3. The rates, tees anc1 charges .et torth in Collier County Ordinance Nos. 86-67, 90-e6 .and 90-87, as a.ended, shall apply to thoso properties located within the Pelican Bay COlUWnity. A copy or the current rate:J, tees and charges is attached horeto as Exhibit "1\." 4. The attach~ rates, tees and charges shall become etrective October 1, 1994. 5. A copy of- the att,ac,h~i ,chedule ot rates, rees and charges shall be posted in the otrice. or the Pelican Bay Services Division and the Collier County Utilities Division and be open to public inspection during business hours.
