Ordinance 90-046 AN ORDINANCE AMENDING ORDINANCE NUMBER 82-2 THE COMPREHENSIVE ZONING REGULATIONS FOR THE UNINCORPORATED AREA OF COLLIER COUNTY, FLORIDA BY AMENDING THE OFFICIAL ZONING ATLAS MAP NUMBER 46-29-8 BY CHANGING THE ZONING CLASSIFICATION OF THE HEREIN DESCRIBED PROPERTY LOCATED ON THE EAST SIDE OF 9TH STREET NORTH AND BORDERED BY JEFFERSON AVENUE AND HEN~R¥ STREET IN SECTION 33, TOWNSHIP 46 SOUTH, RANGE 29 EAST, FROM RMF-6 TO RSF-5, CONSISTING OF 4.65 ACRES; AND BY PROVIDING AN EFFECTIVE DATE. WHEREAS, J. Gary Butler of Butler Engineering, Inc., representing Immokalee Habitat for Humanity, Inc., petitioned .~. the Board of County Commissioners to change the zoning ., classification of the herein described real property; NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY :i!~i' '.' R. Book 179, Page 108, Public Records of Collier County, Florida; and less the following described parcel: ~. Petitioner shall be subject to Ordinance No. 75-21 as amended by Ordinance 89-58 (preservation of native habitat). b. Petitioner shall be subject to Ordinance No. 82-2 as amended by Ordinance 89-57 (use of native species in landscaping). c. Petitioner shall be subject to Ordinance No. 82-37 as amended by Ordinance 89-53 '(removal of exotic species). d. Petitioner shall be subject to the Collier County Comprehensive Plan Policy 12.1.3 (discovery of an archaeological or historical site, artifact or other indicator of preservation). e.Petitioner shall obtain and submit documentation of all necessary local, state and federal permits. f. The petitioner will make every reasonable attempt to preserve pines, oaks, snags and willows on the site, especially within the rear and front yards and retention areas. g. This petition is subject to compliance with the Concurrency Management System developed for the Adequate Public Facilities O:'dinance. Furthermore, all development associated w.'~th this Petition shall be subject to the availability of adequate public facilities as defined in the Adequate Public Facilities Ordinance. h.This project shall be designed for central water and sewer systems. I. Detailed paving, grading, site drainage'.and utility plans shall be submitted to Project Review Services for review. No construction permits shall be issued unless and until approval of the proposed construction in accordance with the submitted plans is granted by Project Review Services. J. Design and construction of all improvements shall be subject to compliance with the appropriate provisions of the Collier County Subdivision Regulations. I!i. k. Work within Collier County right-of-way shall meet the requirements of Collier County Right-of-way Ordinance 82-91. 1. A detailed water management plan and supporting calculations signed and sealed by a professional engineer shall be submitted with the construction ;? m. The project shall be platted in accordance with Collier County Subdivision Regulations to define th~ right-of-way, lots, and easements as shown on the Site Development Plan. · n. Plans originally submitted in 8 1/2" x 11" size .~' sheets shall be revised to match those' of the ~ approved plans. Wi!, o. Connection to the existing water and sewer facilities within 9th Street right-of-way is required and must be completely iljustrated on the final site plan and supporting engineering construction drawings as to location, configuration and size. p. Verification of sewage treatment capacity pursuant to Ordinance No. 80-112 to service this project is ~' required and must accompany the final site plan. q. A letter from the Immokalee Water and Sewer District stating that the District has reviewed and " approved the water and sewer facilities construction documents for service to the project shall be submitted before final construction plan approval. r.
