Ordinance 90-022 m ORDINANCE NO. 90- 22 AN ORDINANCE AMENDING COLLIER COUNTY ORDINANCE NO. 87-100, SECTION ONE, BY PROVIDING FOR INCLUSION OF TWO (2) ENTRANCE MONUMENTS FOR PINEHURST ESTATES WITHIN THE LELY GOLF ESTATES BEAUTIFICATION MUNICIPAL SERVICE TAXING UNIT; PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on July 22, 1986 the Board of County Commissioners adopted Ordinance No. 86-34 which created the Lely Golf Estates Beautification Municipal Service Taxing Unit and prbvided the Board of County Commissioners designate by Ordinance an Advisory CommtttQs composQd of residents from within tho Muniaipal Sarvl¢o Taxing Unit; and WHEREAS, on October 14, 1986, the Board of County CommissionQrs adopted Emergency Ordinance No. 86-71 which amQndQd Ordinance No. 86-34 by amending the boundaries of the Lely Golf Estates Municipal Service Taxing Unit; and WHEREAS, on September 8, 1987, Ordinance No. 87-68 amended Ordinance No. 86-34 as amended by ordinance 86-71 by amending the boundaries of the Lely Golf Estates Municipal Services Taxing Unit and on the same date the Board of County Commissioners also adopted Ordinance No. 87-69 creating the Lely Golf Estates Beautification Advisory Committee; and WHEREAS, on September 22, 1987, the Bo~rd of County Commissioners adopted Resolution No. 87-223 appointing fivQ (5) members to the Lely Golf Estates Beautification Advisory Committee; and WHEREAS, on December 22, 1987, the Board of County Commissioners adopted Emergency Ordinance No. 87-100 creating the Lely Golf Estates Beautification Municipal Service Taxing Unit and the repeal of Ordinance Nos. 86-34, 86-71 and 87-68; and ..! __Wo~ds s~iu~k-throu~h are deleted; words underlined are WHEREAS, on June 14, 1988, the Board of County Com~issioners adopted Ordinance No. 88-57 amending the total millage from one- quarter (1/4) mill to not to exceed one (1) mill in any one fiscal year; and WHEREAS, on January 8, 1990, the Lely Golf Estates Beautification Advisory Committee met and approved a motion to recommend to the Board of County Commissioners that Collier County Ordinance No. 87-100 boundary be amended to include the two (2) entrance monuments for Pinehurst Estates; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, THAT: SECTION ONE. Amendments to Section One of Collier County Ordinance No. 87-100. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding affect the validity of the remaining portion. SECTION THREE. Effective Date. This Ordinance shall become effective upon receipt of notice from the Secretary of State that this Ordinance has been filed with the Secretary of State.
