Ordinance 91-110 ORDINANCE NO. 91- 110 MENDED, THE GROWTH ~NAGEMENT P~N FOR COLLIER COUNTY, FLORIDA BY ~ENDING THE CENTER SUBDISTRICT OF THE FUTURE ~ND USE DESIGNATION DESCRIPTION SECTION TO ALLOW LIGHT INDUSTRIAL USES WITHIN THE INTERCHANG~ ACTIVITY CENTER DIRECTLY RE~TED TO TOLLGAT~ CO~ERCIAL CENTER DEVELOPMENT OF REGIONAL IMPACT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Collier County, pursuant to Section 163.3161 ~:.se~., Florida Statutes, the Florida Local Government Comprehensive Planning and Land Development Regulation Act, was r,~.quired to prepare and adopt a comprehensive plan; and WHEREAS, the Collier County Board of County Commissioners adopted the Collier County Growth Management Plan on January 10, WHEREAS, the Local Government Comprehensive Planning and Land Development Regulation Act of 1985 provides authority for local governments to amend their respective comprehensive plans and outlines certain procedures to amend adopted comprehensive plans r..ursuant to Sections 163.3184 and 163.3187, Florida Statutes; and WHEREAS, Section 163.3187(1) (b) , Florid~ Statutes permits plan amendments which are directly related to a Development of l::egional Impact; and WHERFAS, Collier County adopted Development Order Number 84-1 approving the Tollgate Development of Regional Impact January 17, ].984 and is currently reviewing an amendment to the Tollgate Commercial Center Development of Regional Impact; and WHEREAS, William R. Vines of Vines and Associates representing Tollg.ate Commercial Center Development of Regional ]~mpact has submitted an application to the Collier County Growth l~lanning Department to amend the Future Land Use Element text of the Activity Center Subdistrict to allow light industrial land 'uses within the Interchange Activity Centers (Future Land Use Designation Description Section) of the Growth Management Plan; 139 · '~;~" %~ords s%~uek-~h=ough-are deleted: words underline~ are added. WHEREAS, the Collier County Planning Commission has considered the proposed amendment to the Future Land Use Element t,~xt 'of the Activity Center Subdistrict to allow light industrial land uses within the Interchange Activity Centers (Future Land Use Designa%ion Description Section) of the Growth Management P[[an pursuant to the authority granted to it by Section 163.3174, ~korida Statutes (1989) and has recommended approval of said anendment to the Board of County Commissioners; and WHEREAS, Collier County did submit the proposed amendment to the Department of Community Affairs for preliminary review on or about June 18, 1991, pursuant to Section 163.3184, Florida ~:atutes; and WHEREAS, upon receipt of Collier County's proposed Growth Management Plan Amendment various state and regional agencies and the Department of Community Affairs had ninety (90) days to r,~view the proposed Amendment and did transmit, in writing to Collier County, its comments along with any objections and any. r~commendations for modification, within said ninety (90) days pursuant to Section 163.3184, Florida $~tutes; and WHEREAS, Collier County, upon receipt of written comments from the Department of Community Affairs, must adopt, not adopt, 'o:~ adopt with changes the proposed Growth Management Plan :,~¥ A~,endment within sixty (60) days of such receipt pursuant to 2. S,~ction 163.3184, Florida Statutes; and WHEREAS, the Department of Community Affairs within forty-five (45) days of receipt of Collier County's adopted 1{? G~owth Management Plan Amendment, must.review and determine if the Plan Amendment is in compliance with the Local Government Comprehensive Planhing and Land Development Act of 1985; State Comprehensive Plan; the appropriate Regional Policy Plan and Rule 9,I-5; Florida Administrative Code, pursuant to Section 163.3184, ~_[orida Statutes. NOW, THEREFORE,L_BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ~OLLIER COUNTY, FLORIDA, that: ~ECTION ONE: AMENDMENTS TO THE COLLIER COUNTY GROWTH . . MANAGEMENT PLAN FUTURE IJiND USE ELEMENT TEXT FOR THE ACTIVITY CENTER SUBDISTRICT [w%~ID USE DESIGNATION Collier ~ounty Ordinance No. 89-05, as amended, the Collier (fount~ Growth Management Plan is hereby amended by amending Page LU-I-36 of the Future Land Use Element Text (Future Land Use Designation Description) as follows: "-..-..The standard for intensity of uses within each Activity Center is that the full array of commercial uses may be -..- allowed. It is preferred that all new commercial zoning within Activity Centers shall be in the form of a Planned Unit Development. Based on the unique location and function of Intercha~q~ Activity Centers. some Light Indus~ria~ land uses ~hat serv~ regional m~rkets and derive specific benefit when located in the Interchange Activitv Centers shall be a~lowed, provided each s~lch use is reviewed and found to b~ compatible with existin~ and approved ~and uses, Light Industrial uses may inclqde, bu~ not be %imited to: manufacturing, warehousing, storage and distribution To ensure compatibilitv of Light Industrial %and uses with' other commercial, residential and/or, institutional land in the Activity Center: to maintain the appearance of thgse Activity CeDtevs ~s g~teways to the community; and to mitigate any adverse impacts caused by noise, glare or ~umes by these ~aDd uses design features such as: landscaping. buffering, berming along the Interstate, wooden or masonry fences, and a un~form siqnaqe program shall be required connection with final development plan authorization. Wholesale and storage uses shall not be permitted immediate]~ ~djacent to the right-of-way of the Interstate. No outside ~torage or d~splay is permitted. If hazardous p~odu¢~s or hazardous wastes (as defined in the Ground Water Protection Ordinance No. 91-105 ~s adopted on November 6. 1991) are ~enerated, used or stored oD the site, a containment plan fo? hazardous material handling and emergency response will be reGuired to be provided to the County Manager. Thereafter, an annual report shall be submitted as part of the mop%toting recuiremeDts for Planned Ugit Developments on types, ~4~tities and disposition of hazardous materials, Disposal or release of hazardous waste to soil or water is prohibited. Central sewage systems wil~ be required within the ~deptifled ~nterchanqe Activity Centers; no septic tank systems w%ll be allowed. Specific language as to permitted Light Industrial uses~ compatibility requirements, development standards shall ~ppear in the Planned Unit Development documents or DevelopDent Order, as appropriate. Site specific development details will be reviewed during the Site Development Plag ~pprova~ process. Light Industrial uses shall only be allowed in the following Interchange Activity Centers; a.
