Ordinance 92-089 AN ORDINANCE AMENDING ORDINANCE NUMBER LO91-102 THE COLLIER COUNTY LAND DEVELOPMENT CODE W~ICH ESTABLISHED THE COMPREHENSIVE ZONING REGULATIONS FOR THE UNINCORPORATED AREA OF COLLIER COUNTY, LORIDA BY AMENDING THE OFFICIAL ZONING TLAS MAP NUMBER 060910 BY CHANGING THE ONING CLASSIFICATION FROM "A" AND "A" ITH CONDITIONAL USE "6" (CHURCH) TO C-3" FOR THE HEREIN DESCRIBED PROPERTY CATED 700 FT. EAST OF SANTA BARBARA OULEVARD ON THE SOUTH SIDE OF DAVIS BOULEVARD IN SECTION 9, TOWNSHIP 50 SOUTH, RANGE 26 EAST, COLLIER COUNTY, FLORIDA; PROVIDING FOR STAFF AND PLANNING COMMISSION STIPULATIONS; AND BY PROVIDING AN EFFECTIVE DATE. WHEREAS, Dr. Neno J. Spagna of Florida Urban Institute, Inc., representing New Hope Ministries, Inc., petitioned the Board of County Commissioners to change the zoning ~lassification of ~he herein described real property; NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: ~. ~' The Zoning Classification of the herein described real property located in Section 9, Township 50 South, Range 26 East, Collier County, Florida, is'.changed from "A" and "A" with Conditional Use "6" for a church to "C-3" and the Official Zoning Atlas Map Number 060910, as described in Ordinance 91-102, the Collier County Land Development Code is hereby amended accordingly: West 1/2 of the Northeast 1/4 of the Northwest 1/4 of the Northwest 1/4, Section 9, Township 50 South, Range 26 East, Collier County, Florida. Less an easement on, over and along the North 75 feet of said property for Road right of way. be and the same for which the rezone is hereby approved subject to the following conditions: : 1. A Traffic Impact Statement shall be required at the time of any eDP submission. 2. Detailed paving, grading, site drainage and utility plans shall be submitted to Project Review Services for review. No construction permits shall be issued unless and until approval of the proposed construction in.accordance with the submitted plans is granted by Project Review Services. 3. Design and construction of all improvements shall be subject to compliance with the appropriate provisions of Division 3.2. of Collier County Ordinance No. 91-102. 4. An Excavation Permit will b~ required for any proposed lake(s) in accordance with Division 3.5 of Collier County Ordinance No. 91-102 and SFWMD rules. " 5. Work within Collier County right-of-way shall meet the requirements of Collier County Right-of-Way Ordinance No. 82-91. 6. All requirements of Division 3.2 of the Collier County Land Development Code must be met since no exceptions were requested. 7. Detailed water management plans and calculations, signed and sealed by a Florida Professional Engineer shall be provided prior to construction plan approval. 8. This project shall be required to meet all County ..:.~.. Ordinances.in effect at the time final construction documents are submitted for development approval. 9. Water distribution, sewage collection and transmission facilities to serve the project are to be designed, constructed, conveyed, owned and maintained in accordance with Collier County Ordinance No. 88-76, as amended, a~d other applicable County rules and regulations. 10. Ail customers connecting to the water distribution and sewage collection facilities to be constructed will be customers of the County and will be billed by the County in accordance with the County's established rates. 11. The on-site water distribution system to serve the project must be connected to the District's 16" water main on the south side of Davis Boulevard consistent with the main sizing z~quirements specified in the County's Water Master Plan and extended throughout the project. During design of these facilities, the following features shall be incorporated into the distribution system: A. Dead-end mains shall be eliminated by looping the internal pipeline network. B. Stubs for future system interconnection with adjacent properties shall be provided to the east and the south property lines of the project, at locations to be mutually agreed to by the County and the Developer during the design phase of the project. 12. There shall be only one connection to the County Central Sewer System or a Master Pump Station as follows: The utility construction documents for the project's sewerage system shall be prepared so that all sewage flowing to the County's master pump station is transmitted by one (1) main on-site pump -2- ,oo, station. Due to the design and configuration of the master pump station, flow by gravity into the station will not be possible. The Developer's Engineer shall meet with the County staff prior to commencing preparation of construction drawings, so that all aspects of the sewerage system design can be coordinated with the County's sewer master plan. 13. The following off-site Utilities Improvements shall be made. A · Water The existing off-site water facilities of the District must be evaluated for hydraulic capacity to serve this project and reinforced as required, if necessary, consistent with the County"s Water Master Plan to insure that the District's water system can hydraulically provide a sufficient quantity of water to meet the anticipated demands of the project and the District's existing committed capacity· B. Sewer The existing off-site sewage transmission facilities of the District must be evaluated for hydraulic capacity to serve this project and improved as required outside the project's boundary to provide adequate capacity to · .,'.. transport the additional wastewater generated without adverse impact to the existing transmission facilities. 14. Protected plant and animal species surveys may be required for all separate and additional site plans submitted to Collier County for approval if any previous protected species, surveys"are over two years old. This Ordinance shall ~ecome effective upon receipt of notice from the Secretary Of State that this Ordinance has been filed with the Secretary of State.
