O MARCO COM)gJNITY DEVELOPMENT DISTRICT BT' ~ = 17 ~H ENDING SECTION FIVE PERTAINING TO A~JTORY PROVISIONS GOVERNING THE DISTRICT Y CONSENTING TO THE EXERCISE OF SPECI~;~CRET4R~ OF OWERS RELATING TO PARKS AND RECREATION, STA?£ OSQUITO CONTROL AND SECURITY; PROVIDING OR CONFLICT AND SEVERABILITY; AND BY ROVIDING AN EFFECTIVE DATE. WHEREAS, the Key Marco Community Development District was established on June 30, 1992; and WHEREAS, the Board of Supervisors of the Key Marco Community Development District (District)'has requested the consent of Collier County to exercise certain additional special powers pursuant to Section 190.012(2), Florida Statutes; and WHEREAS, the District's Board of Supervisors has requested that Collier County consent to the exercise of special powers relating to parks and recreation, mosquito control and security; and WHEREAS, Collier County has reviewed t~District Board of Supervisors' request at a public hearing. NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COM)~ISSIONERS OF COLLIER COUNTY, FLORIDA that: SECTION ONE~ Section Five, STATUTORY PROVISIONS GOVERNING DISTRICT of Collier County Ordinance No. 92-45 shall be amended as follows: SECTION FIVE: STATUTORY PROVISIONS GOVERNING DISTRICT The Key Marco Community Development District is governed by the provisions of Chapter 190, Florida Statutes. ,o. 57- ,272 -1- Words A1D~ are added; words s~r~ek-~h~e~h are deleted. ~etection evs~ems, and patrol cars. when auChorize~ by proper aoyernmental aaencies: except that the District may not exercise any POlice Dower. SECTION TWO~ CONFLICT AND SE~ERABILITY In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion. _ - SECTION T~REEI EFFECTIVE DATE. This Ordinance shall become effective upon receipt of notice from the Secretary of State that this Ordinance has been filed with the Secretary of State.
