Ordinance 92-071305; FILED ZI t coLL co =x s~ ~N~ SE~ON ~0~.4.~ P~TA~ TO ~N~ OfFiCiAL ~UAL~F~CAT~ONS; ~R~~. ~1.4.2 PERTAINING TO P~S E~INEK-~ALIFICATIONS$ ~D~NG SE~ON ~0~.4.~ ~ERTA~N~NG TO L~ ~S~E~Oa 0UAL~F~CAT~O~S; PaOV~N~ FOa CO~FL~ ~ WHERF2%S, Collier County Ordinance No. 91-56 created the Collier County Construction Administrative Code for the purposes of uniformly addressing the non-technical and administrative requirements of all the building construction code ordinances; and WHEREAS, it was the intent of Collier County Ordinance No. 91-56 that the provisions of the Collier County Construction Administrative Code shall not be held to deprive any federal or state agency, or any applicable governing authority having Jurisdiction, of any power or authority which it had on the effective date of the Collier County construction Administrative Code; and WHEREAS, certain personnel provisions within the'Collier county construction Administrative ,Code conflict with the County's personnel rules; and WHEREAS, the Board of County Commissioners of Collier County, Florida, wishes to updat& the 'Collier County Construction Administrative Code so that it is consistent with the Collier County's personnel regulations. NOW, THEREFORE BE IT ORDAINED BY THE' BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: SECTION ONE: Section One, the Collier County Building · Construction Administrative Code of Collier County, Ordinance No. 91-56 shall be amended as follows: SECTION 101.4.1 is amended to read as follows: 101.4.1 Building Official Qualifications. The' Building Official shall have at least 10 years experience or equivalent as an architect, engineer, inspector, contractor, or superintendent of construction, or any combination of these, 5 years of which shall have been in responsible charge of work. The Project Review Services Building app~*eab~e--~ve~n*n~-au~he~y? may designate Plans Examiners to administer the provisions of the Building, Electrical, Fire, Gas, Mechanical and Plumbing Codes. The Plans Examiners shall serve as the technical Code Officials for the Building, Electrical, Gas, Mechanical, Plumbing, and Fire Codes. They shall have at least 10 years experience or equivalent, as an architect, engineer, inspector, contractor, or superintendent of construction, or any combination of these, for 5 years of which shall have been in responsible'charge'~ the work. SECTION ~40: CONFLICT A~ND SEVEP~BILITY In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion. SECTION ~"dREE: EFFECtiVE DATE. This Ordinance shall become effective upon receipt of notice from the Secretary of State that this Ordinance has been filed with the Secretary of State.
