REIMBURBEMENT OF EXPENSEB; SETTING FORTH THE
FUNCTZONS~ POWERS ~ DUTIES OF THE LIBRARY
ADVISORY BOARD; DUTIEB OF THE LIBRARY
DIRECTOR OR DEBIGNEE; REVIEW PROCE88;
PROVIDING FOR CONFLICT AND BEVERABILITY;
PROVIDING AN EFFECTIVE D~TE.
WHEREAS, the Board of County Commissioners of Collier
County, Florida, established the Collier County Public Library
and in September, 1957, the Governor of Florida appointed five
(5) individuals to serve as the first Library Advisory Board;
and
WHEREAS, Chapter 71-14, Laws of Florida, provides that
members of the Collier County Library Advisory Board are to be
appointed by the Board of County Commissioners; and
WHEREAS, in January, 1973, the Board of County
Commissioners made its first appointments to the Library
Advisory Board; and
WHEREAS, Collier County Ordinance No. 86-41 established
standards for creation and review of County Boards including
the Library Advisory Board; and
WHEREAS, Collier County Ordinance No. 88-71 confirmed the
creation of the Library Advisory Board and established terms
and conditions of membership on the Library Advisory Board; and
WHEREAS, Collier County Ordinance No. 92-44 amended
Collier County Ordinance No. 86-41~ and
WHEREAS, it is appropriate that Collier County Ordinance
No. 88-71 be emended in certain respects to be consistent with
County Ordinance No. 86-41, as amended.
NOW, THEREFORE~ BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE. Sections Two (2) through Nine (9) of Collier
County Ordinance No. 88-71 are hereby amended to read as

SECTION THREE. TERMS OF OFFICE

considered to have served a full term of office unless that
person has served at least two (2) years. All terms of office
shall expire on the 31st day of December.

SECTION FOUlt. REMOVAL FROM OFFICE; FAILURE TO ATTEND
MEETINGS

Board may be removed from office by a majority vote of the
Board of County Commissioners. Members shall attend all
meetinas of the Board and committees to which they may be
aDDointed. Any Board member who is absent for more than
one-half of the Board's meetinas in a given fiscal Year shall
be deemed to have tendered his or her reel&nation from the
Board. Should any Board member be absent from two
consecutive Board meetinas without a satisfactor~ excuse
accent&bls to the-Board chair~n, the Board chairman shall
state,, such fact at the next re~ularlv scheduled Board meetina
and ,shall thereafter notify, in writin=, the Administrative
Assistant to the County Commission of the Board member's
failure to attend without satisfactory excuse. A member of the
board shall be deemed absent from a meetino when he or she is
not Present durino at least 75% of the meetino. No Board
member shall serve at any meeting after his or her Dg~ition has
been declared vacant bv the Commission.
SECTION FIVE. OFFICERS, QUORUM; RULES OF PROCEDURE
a) Annually, at its first meeting, the membership of the

vote of three (3) or more ~embere shall be necessary in order
to take official action, regardless of whether three (3) or

meeting.

the entire membership, adopt rules of procedure for the
transaction of business and shall keep & record of meetings,
resolutions, fibbings end determinations.

compensation, but shall be entitled to receive reimbursement
for expenses reasonably incurred in the performance of their
i~. duties upon prior approval'of the Board of County

.SECTION EIGHT. DUTIES OF THE COUNTY LIBRARY DIRECTOR OR

Board in accordance with established policies of the Board of
county CommissionersA and the guidelines,~ by=laws, and

b) Prepare the annual budget in accordance with the
~gard's budaetarv advice as specified in Section Seven,
Paragraph ~ ~, above.
c) Provide periodic written reports to the~=&~'F
A~ Board and the Public Services Administrator on the
activities of the Collier County Library System and its
'- finances in accordance with established guidelines. ~

In the event this ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
ordinance is held invalid or unconstitutional by any court of
competent Jurisdiction, such_vortion shall be deemed a
