WHEREAS, the Dove Pointe Community Development District was established on July 20, 1993, by Ordinance No. 93-39 which became ~ effective on July 28, 1993; and iii., WHEREAS, the Board of Supervisors of the Dove Pointe Community i..' · Development District ("District") has requested the consent of .~i~i' Collier County to exercise certain additional special powers · Pursuant to Section 190.012(2}, Florida Statutes~ and ,.., WHEREAS, the District's Board of Supervisors has requested ~ that Collier County consent to the exercise of special powers . . relating to parks and recreation and security; and ~.~ WHEREAS, Collier County has reviewed the District Board of '' Supervisors' request at a public hearing. :~5 NOW, T~REFORE, BE IT O~DAINED BY THE BOAP. D OF COUNTY · COMMISSIONERS OF COLLIER COUNTY, FLORIDA that~ SECTION ONE~ Section Five, STATUTORY PROVISIONS GOVERNING "~' DISTRICT, of Collier County Ordinance No. 93-39 shall be amended as SECTION FIVE: STATUTORY PROVISIONS GOVERNING DISTRICT · The Dove Pointe Community Development District is governed by the provisions of Chapter 190, Florida Statutes. Additionally. the Board of County Commissioners of Collier Coun~v. Florida. hereby consents to the Board of Supervisors of the i~ Dove Pointe Community Development District exercisin~ the followin~ special powers in accordance with Section 190.012(2). Florida . ~tatutes. to plan. establish, accuire, construct or r~con~truct. enlarge or extend, eGUiD, operate and maintain add~OPal Systems '~ and facilities for: ~ (~} Parks and facilities for indoor and Qutdoor recreational, cultural and educational uses, ~ Security. includinG, but not limited~ c~ardhouses, fences a~d. qates, electronic intrustg~1 de~ection systems, and patrQ1 cars. when authorized by _proper Governmental agencies: except that the District ~av not exercise any~D~ice Dower. but ~av contract with Chu.aDorooriate local =eneral DU~OS~ ~overnment a=encies ~Qr an increased level of such se~ices within the Co~ent to exercise the above Dowers bv the Board of CO~V W SECTION ~O~ CO~LICT ~ ~ILI~ In the event'this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion. SECTION ~E~ EFFECT~ DA~. This Ordinance shall become effective upon receipt of notice from the Secreta~ of State that this Ordinance has been filed with the Secreta~ of State.
