Collier County Ordinance No. 88-23, as amended, to provide
~lar~f~cat~on ~n said ordinance relating to the County's
au~or~ty ~o add to assessments the amount of estima~ed
pro-rata share of collection costs and amoun~ of d~scount.

Section 5 of Collier County Ordinance No. 88-23, as
amended, is hereby amended to read as follows:
SE~ION 5. ALT~ATIVE M~OD OF COLLE~ION. As an
alternative method ~o collection by the Clerk as provided ~n
s~section (J} of Section 4 of this Ordinance, the Ooard may,
e$~er at the public hearing held pursuant to subsection (D) of
Section 4 hereof or at such other time as i: deems appropriate,
authorize the collection of the Special Assessments in the
~a~er provided for ad valorem taxes. Such alternative me,hod
shall be au~orized by resolution of the Board and the County
shall comply with all applicable provisions of law relating to
such alternative method, ~cluding Section 197.363, Florida
Statutes, and any successor provision thereto. In the event
such alternative method ia used by the County, the provis~ons
hereof shall be superseded ~o the degree of any conflict with
applicable law or with any agreement between the County and the
Property Appraiser and/or the Tax Collector relating to such
alternative method. Special Assessments relating to an
individual Project shall be collected either by ~he method
described in Section 4 hereof or ~n this~Section 5, not by both

In the event th~s Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If a~y phrase or port[o~ of this
Ordinance ~s held ~nval~d or u~cons~tut~onal by any court of
competent Jurisdiction, such portion shall be deemed a
separate, d~st~nct, and ~ndependent provision and such holding
shall ~ot affect the validity of the remaining portion.
