Administrative Hearings Hearing Officer heard testimony and ~. received evidence concerning the issue of the consistency of the .... '. Adequate Public Facilities Ordinance with the CIE of the Growth Management Plan~ and WHEREAS, on August 27, 1992, the Hearing Officer issued a ~ .- final order finding certain of the challenged portions of the .'i' Adequate P~blio Facilities Ordinance inconsistent with the CIE of · ~%~:" the Growth Management Plan and recommending the imposition of substantial sanctions upon Collier County as a result pursuant to ~.. Section 163.3213(6), Florida Statutes~ and WHEREAS, on March 16, 1993, the Board of County Commissioners of Collier County entered into. a Stipulated Settlement Agreement with the Department of Community Affairs and the other parties to the Adequate Public Facilities Ordinance challenge in which it was · agreed that Collier County would amend the Concurrency Management System of the CIE pursuant to Rule 9J-5.0055, Florida ; Administrative Code, and later emend certain portions of the Adequate Public Facilities Ordinance causing it to become consistent with the Concurrency Management System amendments to ~' the CIE~ and WHEREAS, on April 13, 1993, the Adminl~tration Commission issued its Final Order Nt~mber AC-93-036, approving the Stipulated ?~ Settlement Agreement and directing Collier County to adopt the remedial amendments to the Concurrency Management System of the CIE. NOW~ THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY .. COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that= - 2 - ~J~L~: Remedial Plan Amendment. !' This Ordinance, as described herein, shall be known as the 'm 1993 Concurrency Management System Remedial Plan Amendment for Collier County, Florida. The Amendment consists of amending the Concurrency Management System Objectives and Policies, the Schedule of Capital Improvements, Costs and Revenues by Type of Public Facility and Implementation Programs of the Capital Improvement Element, and Implementation Strategy of the Traffic Circulation Element as set forth in Exhibit A, attached hereto and incorporated by reference herein. : ~]L~L2~: Severability. The monitorin~ system shall enable the County tO determine whether it is adherina to the adooted Level of Service Standards and its Schedule of Cagital ImprovementS, improvement to the LOS "E" road was even needed since a new road increased the corridor capacity and took some of the burden off of the LOS "E" roadway. On State maintained facilities, the County and the State have agreed to the level of service standards described in the element. It is the purpose of this section to set out the strategy for implementing the level of service standards policy of the Traffic ................... ~b~ 1, 1994 1997, It iS th~s nlan's intent to improve all roadways oDeratina under unacceptable conditions within the first three years of the 5 year CIE end State Work groaram, as Der Policy 1.5.3 of the Canital ImDrovement In order to evaluate the current level of service of any segment o£ highway identified om the Ex&sting Traffic Circulation Map, the County will put into place a monitoring program that will determine the existing level of service of those roads with special attention to roads that have exceeded their adopted level of service standard during the previous year. It is the intention of this program to not ~only determine if a level has been exceeded, but to also predict or forecast when a level might be exceeded in the future. Such a monitoring program will permit the proper planning and programming of the various phases of the roadway projects (design, right-of-way acquisition, permitting and construction). Monitorina Proaram The County will be responsible for ma~ntaining quarterly 24 hour " traffic counts on each County facility for which the level of service · standard is applicable. This includes all arterials and collectors identified in the Traffic Circulation Map Series (Map TR-1A). The quarterly counts will be taken in such a manner to allow averaging to · replicate an annual average daily volume. The State is responsible for maintaining an annual count program on all State facilities · identified on Hap TR-1A (W and E). The peak hour interpretation will be performed using the methodology and capacity tables in the Traffic Circulation Element.
