BOARD; SETTING FORTH THE DUTIES OF THE PUBLIC '.' SERVICES ADMINISTRATOR OR HIS DESIGNEE; PROVIDING FOR REVIEW PROCESS; PROVIDING FOR CONFLICT AND SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on October 13, 1992 the Board of County Commissioners directed Staff to prepare an ordinance to create the Collier County Public Health Unit Advisory Board; and WHEREAS, Collier County Ordinance No. 86-41, as amended, sets forth the requirements for creating County advisory boards. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: ~ Creation of the Collier,-Countv Public Health Uni~ : Advisory Board. The Collier County Public Health Unit Advisory Board is hereby created to provide reports and 'recommendations to the Board of County Commissioners regarding policies, operations, finances and services that are being provided or may need to be : provided by the Collier County Public Health Unit to the citizens of Collier County. ~a~ ADoointment and Composition. A. The Board shall be composed of seven (7) voting members, one member from each of the five (5) County Commission Districts and two (2) at-large members. -., .B. Members of the Board shall serve at the pleasure of the Board of County Commissioners and shall be permanent residents and electors of Collier County. C. Appointment of members to the Board shall be by resolution of the Board of County Commissioners and shall set forth the date of appointment and the term of office. ,00K 059P 246 1 ~ECTION THREE. Terms of Office. ;.:,. . .. The initial terms of office of the Board membe~,,~all be as follows: ~ A." Two.(2) members to serve for one (1) year. B&i.~TwO"(2) members to serve for two (2) years. =:~y C.'Three (3)'members'to serve for three (3) years. Thereafter, each appointment or re-appointment shell be for a term of, three (3) years. Terms of office shall be limited to two (2)-.Consecutive terms of service provided, however, that the appointment of a Board member to an initial term of one year shall not be-cOnsidered. a "term of office" and such members shall be ent.itled. to~serve two (2)radditional terms if so appointed. Appointments to fill any vacancies on the Board shall Me for the remainder of the unexpired term of office. ~Eemoval From Office: Failure to Attend MeetinGs. A. Any member of the Board may be removed from office, with or without cause, by a majority vote of the Board of County Commissioners. B. In the event that any Board member is absent from two (2) consecutive Board meetings without a satisfactory excuse acceptable to the Board Chairman, the Board Chairman shall state such fact at the next regularly scheduled Board meeting and shall thereafter notify, in writing, the Public Services Administrator or his Designee of the Board member's failure to attend without satisfactory excuse. The Board of County Commissioners shall review the Board Chairma~'s =notification at a County Commission meeting and shall declare the Board member's position to be vacant if the Commission concurs that the Board member was absent from two (2) consecutive Board meetings without a satisfactory excuse and shall promptly fill the vacant position. A'. Annually the membership of the Board shall elWct a chairman and vice chairman from among the members. Officers' terms. shall be for one..(1) year. with eligibility for re-election, B. The presence of four (4) or.more members shall constitute a quorum of the Board necessary t~. take action and transact business. In addition, an affirmative vote of four (4) or more members shall be necessary in order to take official action, regardless of whether four (4) or more members of the Board are present at the meeting. C. The Board shall, by majority vote of the entire membership, adopt rules of procedure for the transaction of business and shall keep a ~ritten record of meetings, resolutions, findings and determinations. Copies of all Board minutes, : : resolutions, reports, and exhibits shall be submitted to the Board of COunty Commissioners. ~ Reimbursement of ExpenSeS, Members of the Board shall serve without compensation, but shall be entitled to receive reimbursement for expenses reasonably incurred in the performance of their"duties upon prior approval of the Board of County Commissioners. of t~.T~oird. SECTION SEVEN. Functions. Powers and Duties The functions, powers and duties of the Bo rd"~ b as e a follows: -'-~rr~. ..-A..-To. serve-as'a communication link between the Board .-.of County. Commissioners' and the Collier County Public Health Unit. B. To make recommendations to the Public Health Unit · Director, Public Services Administrator, the County Manager and the.-.Board-of County Commissioners as to policies and .-..rprocedures that may beneeded to enhance operational efficiency and budgetary accountability-witthln tl,u Colll~ C. To make recommendations to the Board of County Commissioners regarding the health care services offered by the Public Health Unit, the delivery of those services, the need for additional services and the coordination of .community health care providers_/through the contributions provided by the Board of County Commissioners. D. To provide recommendations to the Public Health Unit Director, Public Services Administr~tor, the County Manager and the Board of County Commissioners regarding the establishment of new rules, procedures and policies that are designed to improve the provision of health care services through the contributions provided by~ the Board of County Commissioners. E. To review ~nd'.make a recommendation to the Board of ' :County Commissioners on any tha~.--le being submitted to the Board of County Commissioners. F. To prepare and submit an annual report to the Public Services Administrator in March of each year which shall summarize the performance of the Collier County Public Health Unit regarding the services that have been provided or that may need to be provided in the future, the effective and 4 OSU ZdO efficient use of the County contribution and "'~ecommendations regarding Board of County Co~ners ..~. G. To review and make recommendations regarding the annual contract between Collier County and the Collier County Public Health Unit. H. The Board may adopt and amend "Guidelines" to govern their meetings and cperations, subject to the approval of the Board of County Commissioners. ..~,. ,.. I. The Board meetings shall be open to the public. ~ Duties of the Public Services Administrator or His Desi~nee.' The. duties of the Public Services Administrator or his Designee shall be: A. To administer the activities of Collier County Public Mealth Unit Advisor~ Board in accordance with established policies and guidelines of the Board of County Commissioners. B.. To provide periodic written reports to the Collier County Public Health Unit Advisory Board and the Board of County Commissioners on the activities of the Collier County Public Health Unit, its finances in accordance ~ith established guidelines and policies of the Board of County Commissioners. C. To assure that all reports, studies, plans, etc. are forwarded to the Collier County Public Health Unit Director, the County Manager and the Board of County Commissioners for their review. D. To attend all C~llier County Public Health Unit Advisory Board meetings. ~a~ Review Process. This Board shall be reviewed once every four (4) years commencing in 1997, in accordance with the procedures contained in Collier County Ordinance No. 86-41, as amended. : ,oo 250 In the event this Ordinance conflicts with any ,a~h'er ordinance of Collier County or other applicable law, '{:he more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall effect the validity of the remaining portion. SECTION ELEVEN. Effective D~te, This Ordinance shall become effective upon receipt of notice from t~e Secretary' of state that this Ordinance has been filed with the Secretary of. State.
