WHEREAS, the Board of County Commissioners adopted Ordinance
No. 86-40 on August 5, 1986 creating the North Naples Roadway
Municipal Service Taxing and Benefit Unit~ and
WHEREAS, the Board of County Commissioners on August 1, 1989
adopted Ordinance No. 89-56, amending Ordinance No. 86-40 by
adding lands to the legal description to be included within the
North Naples 'Roadway Municipal Service Taxing and Benefit Unit$
and
WHEREAS, the Board of County Commissioners deems it
appropriate and in the best interests of the County to further
amend the boundaries of the North Naples Roadway Municipal Service
Taxing and Benefit Unit.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONES AMENDMENT TO SECTION ONE OF COLLIER COUNTY ORDINANCE NO. 86-40, ~ ]&MENDED.
Section One of Collier County Ordinance No. 86-40, as
amended, is hereby amended to read as follows:
Section 1. Creation, Boundaries.
There is hereby created the North Naples Roadway
Municipal Service Taxing and Benefit Unit. The Unit shall
include all lands within the following boundaries:
Parts of Section 10, Township 48 South, Range 25
East as described below:
T~e Southeast Quarter of the Southeast Quarter and
the South 1,070 feet of the Southwest Quarter of
the Southeast Quarter lying East of the Seaboard
Coastline Railroad right-of-way (OR Book 558, Page
492; OR BOOk 535, Page 898; OR Book 1039, Page

SECTION TWO~ CONFLICT AND SEVERABILITY.
The provisions of this Ordinance shall be liberally construed
to effectively carry out its purposes in the interest of public
health, safety, welfare, and convenience. If any section, phrase,
sentence or portion of this Ordinance is for any reason held
invalid or unconstitutional by any court of competent
Jurisdiction, such portion shall be deemed a separate, distinct,
and independent provision, and such holding shall not affect the
validity of the remaining portions thereof.
SECTION THREE: INCLUSION IN TEE CODE OF LAWS AND ORDINANCES.
The provisions of this Ordinance shall become and be made a
part of the Code of Laws and Ordinances of Collier County,
Florida. The sections of the Ordinance may be tenumbered or
relettered to accomplish such, and the word "ordinance" may be
changed to "section", "article", or any other appropriate word.
SECTION FOUR: EFFECTIVE DATE.
This Ordinance shall become effec~ive upon receipt of notice
from the Secretary of State that this Ordinance has been filed
with the Secretary of State.
