AN ORDINANCE AMENDING ORDINANCE NUMBER
91-102 THE COLLIER COUNTY LAND
DEVELOPMENT CODE WHICH ESTABLISHED THE
COMPREHENSIVE ZONING REGULATIONS FOR THE
UNINCORPORATED AREA OF COLLIER COUNTY,
FLORIDA BY AMENDING THE OFFICIAL ZONING
ATLAS HAP NUMBERS 391314 AND 3924N BY
CHANGING THE ZONING CLASSIFICATION OF THE
HEREIN DESCRIBED PROPERTY LOCATED ON
PIa~/~TATION ISLAND APPROXIMATELY ONE MILE
EAST OF THE EVERGLADES CITY LIMITS IN
SECTIONS 13 and 24, TOWNSHIP 53 SOXTTH,
RANGE 29 EAST, COLLIER COUNTY, FLORIDA,
FROM A-ACSC/ST DISTRICT TO KH-ACSC/ST;
PROVIDING FOR STAFF AND PLANNING
COMMISSION STIPULATIONS; AND BY PROVIDING
AN EFFECTIVE DATE.
WHEREAS, Dr. Neno Spagna, representing Sam J. and Joyce
F. Colding, petitioned the Board o[ County Commissioners to
change the zoning classification of the herein described real
property;
NOW, THEREFORE BE IT ORDAINEl) BY THE BOARD OF COUNTY
CO~SSIONERS OF 'COLLIER COUNTY, FLORIDA:
The Zoning Classification of the herein described real
property located in Section 13 and 24, Township 53 South,
Rax~ge 29 East, Collier County, Florida, and as further
described by Exhibit "A" attached hereto, is changed from
A-ACSC/ST to WH-ACSC/ST and the Official Zoning Atlas Map
Numbers 391314 and 3924N, as described in Ordinance 91-102,
the Collier County Land Development Code is hereby amended
· subject to the following conditions:
Water Manaaement:
1. In accordance with the rules and regulations of
South Florida Water Management District and Collier County,
this project shall be designed for water quality treatment
prior to discharge. If the South Florida Water Management
District (SI~4MD) c'laims JurisdiCtion on site, ~1 Surrac~ Water
Management Permit, issued by SFWMD, shall be provided prior
to final site development plan approval.
Environments I:
1. Upon approval, this fezone is subject to a forty-
five (45) day appeal period by the Florida Department of
Community Affairs pursuant to Rule 9J-1 of the Florida
Admini~=rative Code.

1. No subdivision shall occur which would allow more
than 4 dvalling units per acre.
This Ordinance shall become effective upon receipt of
notice from the Secretary of State that this Ordinance has
been filed vith the Secretary of State.
