Ordinance 94-02 ORDINANCE NO. 94- 2 N ORDINANCE AMENDING COLLIER COUNTY ORDINA_~CE z-24 BY EX~DING THE MOR^TORIUH PROMIBITI~ NSTAL~TION OF D~INAGE ~V~TS IN~ING~IPE~ OR ~ APP~T~CES WI~IN ~E ~ALES IN~E P~LIC RIG~-OF-WAY OF ~E AR~ G~LLY APLES PA~ ~TIL DEC~BB 31, 19945 PROVID~G FO~ CON~I~ AND S~BILI~; ~D PROVIDING ~ EFFE~IVE DATE. ~S, the Board of County C~issioners of Collier County, Florida, has deten~ned that it is in the best interest of the citizens of Collier County and to prote~ the health, safety and velfare of the citizens of Collier County to extend the moratorium for an additional year, until December 31, 1994, prohibi~inq the penitting of the conversion of swales to ~Zverts in the publiD rights-of~ay within an area generally kn~ as Naples Park, a platted su~ivision located in Collier County, Florida. NOW, ~EFORE, BE IT ORDAIN~ BY ~E ~ OF CO~ CO~ISSION~S OF CO~I~ CO~, ~RIDA, that: Section One. ~endment to Section Four of Collier County Ordinance No. 91-24 Section Four of Collier County Ordinance No. 91-24 is here~ amended to read as foll~sz SE~ION FO~z IMPOSITION OF MO~TORI~$ D~TION A moratorium proscribing the issuance of Petit(s) to Perfo~ Work and/or Maintenance in ~blic Rights-of-way ~rsuant to Collier County Ordinance No. 82-91, as amended, is imposed specifically to prohibit the installation of drainage ~lve~ including pipes or other appurtenancos within the swales within the public rights-of-way, except for the ~lvert retired to install a driveway for homesite access. ~e moratorium imposed hereby shall commence as of the effective date of this Ordinance and shall continue In effect until Collier County receives approval from the Florida DepaRment of Environmental Re~lat~on to teminate said moratorium, but not " 1 ~' Words underlined are added; words =tr~=r: '~ ..... ~ are deleted. :~ . ,;, longer than through December 31, :~9-~ 1994 pursuant to this Ordinance.
