Ordinance 95-79 MI ORDINAlICE AMENDING COLLIER COUN="/ORDINM~C~ NOR C, · 91-24, AS AMENDED, BY EXTENDING THE NORATORIU~ PROHIBITING THE INSTALLATION OF DRAINAGE CULV~RT~]] INCLUDING PIPES OR OTItER APPURTENANCES WITHI~.TH~ SWALES IN THE PUBLIC RIGHT-OF-WAY OF THE AREA GENERALLY KNOWN AS NAPLES PARK UNTIL DECEMBER 31~.~ 1996~ PROVIDING FOR CONFLICT AND BEVERABILITY$ PROVIDING FOR INCLUSION IN THE CODE OF LAWS AND ORDINANCESI AND PROVIDING AN EFFECTIVE DATE.-- _ NtIKRZAS, the Board of County Commissioners of Col~e~ounty~ Florida, has determined that it is in the best interest of the citizens of Collier County and to protect the health, safety and welfare of the citizens of Collier County to extend the moratorium until December 31, 1996, prohibiting the permitting of the conversion of scales to culverts in the public rights-of-way within an area generally known as Naples Park, s platted subdivision located in Collier Count~ Florida. NOI4, THEREFORE, BE IT ORDAINEDBYTHE BOARD OF COUlfTY COKHISSlONERS OF COLLIER COUNTY, FLORIDA, that= Section One. Amendment to Section Four of Collier County Ordinance No. 91-24, as amended. Section Four of Collier County Ordinance No. 91-24, as amended, is hereby amended to read as follows= SECTION FOURs IHPOSITION OF HORAT~RIIIMI DURATION A moratorium proscribing the issuance of Permit(s) to Perform Work and/or Haintenance in Public Rights-of-way pursuant to Collier County Ordinance No. 82-91, as amended, is l~posed specifically to prohibit the Installation of drainage culvert including pipes or other appurtenances within the swales within the public rights-of-way, except for the culvert required to install a driveway for homesits access. The moratorium Imposed hereby shall commence as of the effective date of this Ordinance and shall continue in effect until Collier County receives approval from the Florida Department of Environmental Regulation to terminate said moratorium, but not longer than through ~~pursuant to this Ordinance. 1 Words underlined are added; words~are deleted. Ssctton T~o, Conflict and Ssvsrabtllty Ths provisions o~ this Ordinancs shall be liberally construed to sf~sctively carry out its purposes in the interest o~ public health, safety, vslfars, and convenience, Z£ any section, phrase, sentence or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent ~urisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity o£ the remaining portions thereof. Section Three. Inclusion in the Code of Lays and Ordinances. The provisions of this Ordinance shall become end be made a part oZ the Code of Lays and Ordinances of Collier County, Florida. The sections of the Ordinance may be rentmbered or relettered to accomplish such, and the vord 'ordinance' say be changed to "sectionw, "article', or any other appropriate vord. Section Four. Ef~ective Date· This Ordinance shall become effective upon filing this Ordinance ~ith the Department of State.
