Ordinance 95-39 AN' ORDINANCE AMEN'DI.'G ORDINANCE N COMPREHENSIVE ZONING REGULATIONS FOR THE' UNINCORPORATED AREA OF COLLIER COUNTY, F~RIDA, BY ~ENDING THE OFFICIAL ZONING AT~S MAP N~BER 9512S BY CHANGING THE ZONING C~SSIFICATION OF ~E HEREIN DES~IBED PROP~TY ~CAT~ ON THE NOR~EAST CORNER OF AIRPORT ROAD (C.R, 31) AND PINE RIDGE ROAD (C.R. 896), IN SE~ION 12, TOWNSHIP 49 SOUTH, ~NGE 25 EAST, COLLIER CO~TY, FLORIDA, FROM C-1 TO C-4 FOR R~AIL USES; AND BY PROVIDING AN EFFE~IVE DATE. WHEREAS, Robert L. Duane, of Hole, Montes& Associates, Inc., representing Andtea Peane on behalf of Land Trust 5321, petitioned the Board of County Commissioners to change the zoning classification of the heroin described real property; NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COMITY, FLORIDA: The Zoning Classification of the real property as more particularly described by Exhibit "A", attached hereto and incorporated by reference herein, and located in Section 12, Township 49 South, Range 25 East, Coillet County, Florida, is changed from C-1 to C-3 and the Official Zoning Atlas Map Number 9512S, as described in Ordinance 91-102, the Collier County Land Development Code, is hereby amended accordingly. The heroin described real property is the same for which the rezone is hereby approved subject to the following conditions: 1. Access to.Airport Road or Pine Ridge Road from any lot is hereby expressly prohibited. 2. The driveway centerline location from Airport Road along YMCA Road shall be a minimum of 125' from the property corner. The driveway centerline location from either Pine Ridge Road or YMCA Road along Museum Road shall be a minimum of 75' from the property corner. 3. Development of the property shall reflect all the elements of a unified plan of development, irrespective of whether or not there are seFarate fee ownerships at -1- the time development is [orthcominq. Element:; oE the unified plan off development ~hail inch~cJe the :oLlowinq features: (i) A common architectural theme, the elements of which will be determined at the time of first submission of an application for site development plan approval. Said common architectural theme shall include the following: (a) the application of a common pallet of colors (b) similarity of architectural features (c) uniform signage and lighting (d) Specification addressing the above elements · shall be submitted to the Development Services Director for approval after which they shall be included as convenience in any conveyance of the land. (ii) Points of ingress and egress shall be common to an internal driveway system which connects all users of the property. This Ordinance shall become effective upon receipt of notice from the Secretary of State that this Ordinance has been filed with the Secretary of State.
