W~EREAS, the State of Florida has adopted the 1990 National Electric Code as the minimum state electric code; and WHEREAS, Chapter 125, Florida Statutes, grants the right and power to counties to provide for the health, welfare and safety of existing and future residents by enacting and enforcing regulations necessary for the protection of the public including Electrical Code Ordinances; and WHEREAS, Section 553.18, Florida Statutes, authorizes Collier County to adopt and enforce additional or more stringent standards than those prescribed in the then current "Florida Electrical Code"; and WHEREAB, this Ordinance re-adopts from Ordinance No. 91-62 a [1 prior local amendments to the 1990 Edition of the National Electrical Code {Section 22-123 of the Code of Laws and Ordinances of Collier County, Florida) and adds only two (2) new local amendments as follows: amends Exception No. 3 in subsection (a) of Section 300-1 and adds a new Exception No. 3 to Section 680-25 (d); and WHEREAS, the County' s Building Department has been reorganized within the Division of Community Development Services and the "Customer Service Section and Building Plan Review Section" is now designated as the "Department of Building Plan Review and Permitting", and the Service Section" is now designated as the · Department of Development Compliance" NOW, TMEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY FLORIDA, That: SECTION ONZz The "National Electrical Code, 1993 Edition", as published by the National Fire Protection Association is adopted by reference as the "Collier County Electrical Code". For Administration and Authority Jurisdiction under this Ordinance, refer to the "Collier County Building Construction Administration Code". SXCTION THiEf: The "National Electrical Code, 1993 Edition", as adopted is hereby amended by local amendment as follows: ~ 2 - WIRIN~ DESIGN AND PROTECTION ARTICLE 210 o BPa~NCH CIRCUITS C. REQUIRED OUTLETS 210-52 - DWELLING UNIT RECEPTACLE OUTLETS Add subsection (i) to read as follows: (i) Refrigerators and fixed appliances shall be wired on individual minimum 20 ampere circuits and 20 amp receptacle. ARTICLE 230 - SERVICES A. - GENERAL 230-7 - OTHER CONDUCTORS IN RACEWAY OR CABLE Add subsection (a) to read as follows: (a) Separately metered conductor~ shall not be installed in the same raceway. Line and load conductors shall not be run in the same raceway, trough, or wire way. B. - OVERHXAD SERVICE - DROP CONDUCTORS 230-21 - OVERHEAD SUPPLY Add subsection (a) to read as follows: (a) All services shall be run in galvanized rigid threaded metal conduit from mast head to meter. The diameter of a roof mast shall be a minimum of two (2) inches. Special permisnion is required for use of; rigid non-metallic conduit and electrical metallic tubing. 2 230-23 - SIZE AND RATING Amend subsection (b) to read as follows: (b) A minimum 100 ampere service shall be provided for all dwelling units and commercial structures. Delete exception to 230-23(b). C. - UNDERGROUND SERVICES - LATERAL CONDUCTORS 230-31 - SIZE AND RATING Amend subsection (b) to read as follows: (b) A minimum 100 ampere service shall be provided for all dwelling units and commercial structures. Delete exception to 230-31(b). D. - SERVICE o ENTRANCE CONDUCTORS 230-42 - SIZE AND RATING 230-42(b) - UN(FROITNDED CONDUCTORS Amend subsection (b) to read as follows: (b) A minimum 100 ampere service shall be provided for all dwelling units and all commercial structures. Delete subsections (1), (2), (3) and exceptions to 230-42(b). 230-43 - WIRING METHODS FOR 600 VOLTS, NOMINAL, OR LESS Amend Section 230-43 to read as follows: Service entrance conductors shall be installed in accordance with the applicable requirements of this code covering the type of wiring method used and limited to the following methods: (1) rigid metal conduit; (2) intermediate metal conduit; (3) busways, (4) wireways, and (5) auxiliary gutters. Special permission is required for use of rigid. ncnometallic conduit and electrical metallic tubing. CHAPTER 3 - WIRING METHODS AND MATERIALS ARTICLE 300 - WIRING METHODS A - GENERAL R~QUIRPJ4ENTS 300-1 - SCOPE 300-1(a) - ALL WIRING INSTALLATIONS Amend subsection 300-1(a) by adding a new Exception No. 3: Exception No. 3: Only those secticns referenced in Article 760 shall apply to fire protective signaling circuits in one and two family dwellings. All other structures including retrofitring existing structures shall install conductors in approved conduit, tubing or armored cable and in all other ways shall conform to Article 760 and National Electric Code. Amend subsection 300-1(a) by adding Exception No. 8 to read as follows: Exception No. 8: Type NM and NMC Cables shall not be permitted in any structure except as provided in Section of this ordinance. 30O-l(C) - OTHER CONDUCTORS IN RACEWAY OR CABLE Add subsection (c) to read as follows: (c) Separately metered conductors shall not be installed in the same raceway. ARTICLE 336 - NONMETALLIC-SHEATHED CABLE 336-4 - USES NOT PERMITTED Amend subsection 336-4(a) to read as follows: Type NM and NMC cables shall not be permitted in any structures except residential structures three (3) stories or less in height. Areas in residential structures identified for other occupancy classification uses shall be in conduiz and conform to all appropriate section of the code. CHAPTER 5 - SPECIAL OCCupANCIES ARTICLE 550 - MOBILE HOMES AND MOBILE HOMES PARKS C. - SERVICES AND FEEDERS 550-23 - MOBILE HOME SERVICE EQUIPMENT 550-23(A) - SERVICE EQUIPMENT Add subsections (1), (2) and (3} to read as follows: (1} Every service to a mobile home shall have an approved main fuse or breaker located at the meter and a fuse or breaker in the mobile home. (2) No electrical power shall be supplied to a mobile home, except a travel trailer, until the home is' tied down in conformity with Collier County Mobile Home Ordinance No. 89-45 as amended or superseded. (3} Pole for mounting meter and disconnect shall be Class 6 or 7 treated wood or equal, to be set a minimum of five feet (5') deep, properly preserved to protect it from decay and insect damage. CHAPTER 6 - SPECIAL EQUIPMENT ARTICLE 680 - SWIMMING POOLS, FOUNTAINS AND SIMILAR INSTALLATIONS B. PERMANENTLY INSTALLED POOLS 680-20 - UNDERWATER LIGHTING FIXTURES (a) GENERAL Amend subsections 680-20(a)(1) to read as follows: (1) Swimming pool and spa lighting shall be low voltage supply from an approved transformer and in all other ways shall conform to the National Electric Code. All pools shall have a rough and final electrical inspection. Delete subsection 680-20{a)(2). Renumber subsection (a)(3) as (a)(2). Renumber subsection (a) (4) as (a) (3). 680-25 - M~THODS OF GROUNDI'NG 680-25 (d) - PA/qELBO~RDS Amend subsection 680-25 (d} by adding a new Exception No. 3: Exception No. 3: In existing one and two family dwelling units, the equipment grounding conductors between the service equipment and a remote panelboard shall not be required to be in the conduit listed in paragraph (d) if the interconnection is by means of a flexible metal conduit or approved cable assembly with an insulated or covered equipment grounding conductor. The ampacity of the conductors shall be not less than the rating of the remote panel and the panel shall be rated a minimum of thirty (3) amperes. SECTION THREE~ REPEAL OF ORDINANCE NO. 91-62 Collier County Ordinance No. 91-62 is repealed in its entirety as of the effective date of this Ordinance. BECTION FOURz CONTLICTAND BEV~RABILITY In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FIVE~ INCLUSION IN THE CODE OF T~E LAWS AND ORDINANCES The provisions of this Ordinance shall become and be made a part of the Ccde of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be tenumbered or relettered to accomplish such, and the word "ordinance" may be changed to "section", "article", or any other appropriate word. SECTION IZXI FFrECT~Vi DATE - DELAYED. This Ordinance shall be forwarded to the Secretary of State without delay, but this Ordinance shall not become effective until 6:00 A.M. on July 1, 1995.
