Ordinance 95-01 ORDINANCE NO. 95- [ AN ORDINANCE CREATI.G T.E MARCO ISLA~D VISIOr~F' PLANNING ADVISORY COr{MXTTEE TO ASSIST IN THE DEVELOPMENT OF THE MARCO ISLAND MASTER PLAN; PROVIDING FOR APPOINTMENT AND COMPOSITION; .... PROVIDING FOR THE TERMS OF OFFICE; PROVIDING FOR OFFICERS; QUORUM, RULES OF PROCEDURE, REMOVAL FROM OFFICE AND FAILURE TO ATTEND AND DUTIES OF THE COMMITTEE; PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING FOR THE INCLUSION OF THIS ORDINANCE IN THE CODE OF LAWS AND ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Collier County Growth Management Plan was adopted by the Board of County Commissioners in January, 1989 to provide for the orderly and planned growth in Collier County; and WHEREAS, the Board of County Commissioners provided for more specific comprehensive plans be prepared for both Immokalea and Golden Gate Area because of the unique characteristics of those communities; and WHEREAS, the Board of County Commissioners had established advisory committees to assist in the preparation of both the Immokalee and Golden Gate Area Master Plans; and WHEREAS, the Board of County Commissioners has directed the preparation of a Master Plan for Marco Island beginning in fiscal year 1994/1995; and WHEREAS, the public input by the citizens of Marco Island is critical to the successful implementation of the Marco Island Master Plan. NOW, THEREFORE, BE XT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: SECTION ONE[ Creation of the ~ Advisory Commi%te~, This Ordinance is enacted pursuant to Collier County Ordinance No. 86-41, as amended by Ordinance No. 92-44, to establish and create the Marco Island Citizens Vision Planning Advisory Committee, hereinafter referred to as the "Vision Planning Committee" or the "Committee". BEC'~ION ~01 A. The Vision Plannin9 Committee shall consist of ten members which representation shall consist of no more than one (1) officer or director from any one (1) organization/association and should include the following associations: Marco Association of Condominiums Marco Island Area Association of Realtors Marco Island Area Ministries Marco Island Chamber of Commerce Marco Island Civic Association Marco Island Taxpayers Association The balance of the membership shall be residents of Marco Island and shall not necessarily represent any one particular group or association, but may be a member of such an association but not serving as an officer. B. Members of the Vision Planning Committee shall be appointed by and serve at the pleasure of the Board of County Commissioners. Said members shall be permanent residents and electors of the Marco Island Community. C. Appointment of members to the Committee shall be by Resolution of the Board of County Commissioners, which Resolution shall set forth the date of appointment and the term of office. SECTION THREE= Terms of Office. The Vision Planning Committee shall be established for a two (2) year time period which shall commence with the effective date of the Resolution appointing said members and conclude after the final adoption hearing for the Marco Island Master Plan by the Board of County Commissioners. SECTION FOUR= $ s o m u o edu e e ova O · A. At its earliest opportunity, the membership of the Committee shall elect a chairperson and vice chairperson from among the members. 2 B. The presence of six (6) or more members shall constitute a quorum of the Committee necessary to take action and transact business. c. The Committee shall, by majority vote of the entire membership, adopt rules of procedure f~r the transaction of ~usiness and shall keep a written record of meetings, resolutions, findings and determinations. Copies of all Committee minutes, resolutions, reports and exhibits shall be su~itted to the Board of County Commissioners. D. Any member of the Committee may be removed from office by a majority vote of the Board of County Commissioners. E. If any member of the Committee fails to attend two (2) consecutive Committee meetings without a satisfactory excuse, or if a member is absent from more than one-half of the Committee's meetings in a given calendar year, the Committee shall declare the member's seat to be vacant and the vacancy shall be filled by the Board of County Commissioners. SECTION FIVE~ o ow u C tte . The functions, powers and duties of the Committee shall be as follows: A. To aid and assist in the preparation of the Marco Island Master Plan. This would include assistance with data collection, surveys, provide for visionlog workshops to elicit citizen input, develop policy recommendations and review and make recommendations on the Capital Improvements Element as it relates to Marco Island. B. To provide recommendations to the Board of County Commissioners on policy related to the development of the Master Plan. C. To provide a forum for broad citizen input and participation. D. To provide information to the general public and keep the citizens of Marco Island involved and informed of the planning process as it relates to the formulation of the Marco Island 3 I Master Plan. E. To perform or assist with any other function or duty as it relates to the development of the Harco Island Haster Plan as requested by the Board of County Commissioners. F. The Committee meetings shall be open to the public. SZCTION SlX~ Conflict and SeverabilitY. In the event this Ordinance conflicts with any other ordinance of Collier County or cther applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct and independent provision end such holding shall not affect the validity of the remaining portion. SECTION SZVENx Inclusion in the Code of Laws and Ordinance, The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or relettered to accomplish such, and the word "ordinance" may be changed to "section", "article", or any other appropriate word. BECTION El(flITs ~ffeotive Date. This Ordinance shall become effective upon receipt of notice from the Secretal7 of State that this Ordinance has been filed with the Secretary of State.
