AN ORDINANCE AMENDING ORDINANCE NUMBER
91-102, THE COLLIER COUNTY LAND
DEVELOPMENT CODE WHICH ESTABLISHED THE
COMPREHENSIVE ZONING REGULATIONS FOR THE
UNINCORPORATED AREA OF COLLIER COUNTY,
FLORIDA, BY AMENDING THE OFFICIAL ZONING
ATLAS MAP NUMBER MB6C BY CHANGING THE
ZONING CLASSIFICATION OF THE HEREIN
DESCRIBED PROPERTY LOCATED JUST NORTH OF
THE MARCO ISLAND LIBRARY ACROSS MISTLETOE
COURT AND ON THE WEST SIDE OF SOUTH
HEATHWOOD DRIVE IN SECTION 17, TOWNSHIP
52 SOUTH, RANGE 26 EAST, COLLIER COUNTY,
FLORIDA, FROM RSF-4RP TO "P" FOR A
PARKING AREA FOR THE MARCO ISLAND
LIBRARY; PROVIDING FOR STAFF AND PLANNING
COMMISSION STIPULATIONS; AND BY PROVIDING
AN EFFECTIVE DATE.
WHEREAS, Thomas A. Donegan of Office of Capital Projects
Management, representing Collier County Board of County
Commissioners, petitioned the Board of County Commissioners
to change the zoning classification of the herein described
real property;
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA:
SECTION ONE:
The zoning classification of the real property as more
particularly described by Exhibit "A", attached hereto and
incorporated by reference herein, and located in Section 17,
Township 52 South, Range 26 East, Collier County, Florida, is
changed from RSF-4RP to "P" and the Official Zoning Atlas Map
Number MB6C, as described in Ordinance 91-102, the Collier
county Land Development Code is hereby amended accordingly.
The herein described real property is the same for which the
rezone is hereby approved subject to the following
conditions:

SECTION TWO:
This Ordinance shall become effective upon filing with
the Department of State.

~GREEMENT
I, Thomas A. Donegan, as owner or authorized agent for
Petition R-96-8, agree to the following stipulations requested
by the Collier County Planning Commission in their public
hearing on August 1, 1996.
PLANNING:
a. An exotic vegetation removal, monitoring, and maintenance
(exotic-free) plan for the site shall be submitted to Current
Planning Environmental Review Staff for the review and approval
prior to final site plan/construction plan approval.
b. This project shall be administratively reviewed during the Site
Development Plan (SDP) review process for consistency with the
setback, landscape, buffer, parking, and other relevant
requirements of the Land Development Code.
c. The parking area proposed for the subject site (Tract "D") shall
be limited to a maximum of 75 parking spaces.
TRANSPORTATION:
a. Access to the site shall be from Mistletoe Court so as to
minimize delays and capacity constraints on Heathwood.
