B OR THE COUNTY ADNINIBTRATOR; PROVIDING FOR THIRD PARTY BILLINGB WHICH BHALL BE EBTABLIBHED BY THE COUNTY ADHINIBTRATOR; PROVIDING FOR ALTERNATIVE NETHODS OF PAYMENT; REPEALING ORDINANCE NO. 94-44; PROVIDING FOR CONFLICT AND BEVERABILITY; PROVIDING FOR INCLUBION IN TEE CODE OF LAWB AND ORDINARCEB; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Collier County Board of County Commissioners (heretnafter sometimes referred to as nthe Boardn) provides ambulance services through its Department of Emergency Medical Services (heretnafter sometimes referred to as hEMSn) to the citizens and visitors of Collier County; and WHEREAS, the annual I~45 c~erating budget is funded exclusively through ad valorem taxes and user fees; and WHEREAS, the Board has resolved that it is appropriate that the users of such services pay for the services provided in accordance with an established rate schedule; and WHEREAS, it is necessary to establish billing and collection procedures to assure payment of service charges; and WHEREAS, it is in the interest of the citizens of Collier County that consistency be provided for in the application of these procedures to the public. NOW. THEREFORE, BE IT ORDAINED BY THE BOARD ~OF eeUNTY~ COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: ~ ~- r-- BEeTION ONEt FINDINGS AND PURPOSE Pursuant to Section 125.01 (1) (e) , Florida Statute~ the. card of County Commissioners of Collier County, Florida finds that it is empowered to provide ambulance services. In recognition of said findings, it is the purpose of this Ordinance to update the common billing and collection procedures for County ambulance services. SECTION TWOx TITLE AND CITATION  ,Ordinance shall be known and may be cited as the "Billing and ~oll~.~ion Procedure for Collier County Ambulance Services ~C~rk ~a*__ , ~ '/ Pagc I of 3 8BCTION T~IEI; ~PPLIC~BILITY This Ordinance shall apply to services provided in the incorporated and unincorporated areas of Collier County. ~ICTXON FOO'RI R3,TIB; YlZ8 3.ND The Board ol County Commissioners shall establish, by Resolution, the rates, fees and charges for ambulance services. Such rates, fees and charges may be waived from time to time by the Board of County Commissioners or County Administrator in accordance with criteria established by this Ordinance. Waivers are liai~ed · Valid public purpose~ · Estates that have no assets (~or deceased or incompetent persons). The Board oE County Commissioners may establish ~uidelines in accordance with State law Eor the processing of hardship cases and payment plans. BECTZON FZVEI BZLLZNGXND COLLECTZONPROC~DURB8 The Board of County Commissioners shall establish billing procedures and collection procedures by resolution for Collier County ambulance service ~ees and charges. These procedures may be supplemented by policies or procedures established by the County Administrator. Service recipient or responsible parties, who do not provide insurance information will be responsible for payment in accordance with criteria established by this Ordinance. SECTION GIla KEDIC~ItEAJ~DKEDIC~ID BILLINGS The Revenue Services Department shall bill Hedicare and Hedicaid for eligible ambulance service recipients in accordance with applicable Hedicare and Hedicaid rules. The Revenue Services Department shall accept the assignment of payments as a provider in accordance with applicable Hedicare and Hedicaid rules. Procedures for Hedicare and Hedicaid billing will be established by the Board of County Commissioners or the County Administrator in accordance with criteria established by this Ordinance. SECTION 8~v~t THIRD P3~RTY BILLINGS Third party billin~ assignment of payments shall be accepted with the unpaid difference, if any, remainin~ the responsibility Page 2 of 3 the service recipient or responsible party. Procedures for third party billing will be established by the County Administrator. SECTION EIGHTS ALTERNATIVE METHODS O~ PAYMENTS The Revenue Services Department may accept credit card payment for ambulance service(s). Specific credit cards shall be limited to those for which service contracts exist. BECTIONIIN~I RZPEALOF COUNTY ORDINANCE NO. 94-44 Collier County Ordinance No. 94-44 is kqreby repealed. SECTION TEN: CO]ITLICTAZrD SEVERABILITY In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held invalid or unconstitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION ELEVENz IMCLUSZON ZNT~E CODE OF LAWS AND ORDINANCES. The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or relettered to accoEplish such, and the word "ordinance" may be changed to "section", 'article", or any other appropriate word. SECTION TWELVEz EFFECTIVE DATE. This Ordinance shall become effective upon filing on July 1, 1996.
