Ordinance 96-25 ORDINANCE NO. 96- 25 ~,~ ~ ,~../ AN ORDINANCE J~MENDING ORDINANCE N~BER ~ ~/. 91-102~ THE COLLIER COUNTY ~ND DEVELOPMENT CODE WHICH ESTABLISHED THE COMPREHENSIVE ZONING REGU~TIONS FOR THE i:NINCORPO~TED AREA OF COLLIER COUNTY, FLORIDA, BY ~ENDING THE OFFICIAL ZONING AT~S ~P N~BER GGE26 BY CHANGING THE ZONING C~SSIFICATION OF THE HEREIN DESCRIBED PROPERTY LOCATED AT THE NORT~EST CO~ER OF PINE RIDGE ROAD (C.R. 896) AND ISLE OF CAPRI ROAD (C.R. 951) IN SECTION 15, TOWNSHIP 49 SOUTH, ~NGE 26 EAS.T, COLLIER CO~TY, F~RIDA, FROM "E" ESTATES TO "C-3"; PROVIDING FOR STAFF AND P~NNING CO~ISSION STIPU~TIONS; AND BY PROVIDING AN EFFECTIVE DATE. WHEREAS, Mark Lamoureux of Mark Lamoureux Engineering, · representing Michael Hoy, Trustee, petitioned the Board of County Commissioners to change the zoning classification of the herein described real property; NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION ONE: The zoning classification of the real property as more particularly described by Exhibit "A", attached hereto and incorporated by reference herein, and located in Section 15, Township 49 South, Range 26 East, Collier County, Florida, is changed from "E" Estates to "C-3" and the Official Zoning Atlas Map Number GGE26, as described in Ordinance 91-102, the Collier County Land Development Code is hereby amended accordingly. The herein described real property is the same for which the rezone is hereby approved subject to the following conditions: 1. permitted uses. The following uses, as defined with a number from the Standard Industrial Classification Manual (1987), or as otherwise provided for within this Section are permitted as of right, or as uses accessory to permitted uses in the Commercial Intermediate District (C-3). a. Unless otherwise provided for in this section, all permitted uses of the C-2 Commercial Convenience District. b. Apparel and accessory stores (groups 5611-5699). -1- C. Auto and home supply stores (5531}. d. Business services (groups 7313, 7322, 7323, 7334, 7338 & 7389), subject to approval of the Planning Services Director. e. Eating places (5812 only). All establishments engaged in the retail sale of alcoholic beverages for on-premises consumption are subject to locational requirements of Section 2.6.10. f. Food stores (groups 5411-5499). g. General merchandise stores (groups 5331 and 5399) h. Group care facilities (Category I and II, except for homeless shelters)~ care units, except for homeless shelters~ and nursing homes, subject to Section 2.6.26. i. Home furniture, furnishing, and equipment stores (groups 5712-5736). J. Libraries (8231). k. Miscellaneous repair services (groups 7629-7631). 1. Miscellaneous retail (groups 5912-5963 except pawnshops and all uses dealing with secondhand merchandise, 5992-5999). m. Nondepository credit institutions (groups 6111-6163). n. Paint, glass and wallpaper stores (5231). o. Personal services (groups 7212, 7215, 7216 nonindustrial dry cleaning only, 7221-7251, 7291). p. Public administration (groups 9111-9199, 9229, 9311, 9411-9451, 9511-9532, 9611-9661). q. Retail nurseries, lawn and garden supply stores (5261). r. Veterinary services (groups 0742, 0752 excluding outside kenneling). s. Videotape rental (7841). t. United States Postal Service (4311 except major distribution centers). u. Any ~ther general commercial use which is comparable in nature with the foregoing uses including buildings for retail, service and office purposes consistent with the permitted uses and purpose and intent statement of the district. 2. Final access points shall be subject to the Access Management Policy set forth in Resolution No. 92-442 and which shall be determined at the time of site development plan approval pursuant to Division 3.3. 3. Arterial level street lighting shall be required at all access points concurrent with their establishment. 4. In the event the land is not replatted, and, therefore subject to the provisions of Division 3.2, sidewalks shall be installed prior to the issuance of any Certificate of Occupancy. -2- 5. A twenty (20) foot landscape buffer achieving an eighty (80) percent opacity rating within one year of the issuance of the first certificate of occupancy shall be effectuated along the north boundary of the property. 6. The existing driveway along the west side of the property from Pine Ridge Road shall continue to serve as a common driveway for both properties lying north of the property and the subject property. 7. Site related exterior lighting shall not exceed a height of eighteen (18) feet and shall be so mounted as not to extend any illumination on to adjacent property. Parking lot lighting standards shall incorporate lighting fixtures that direct illumination to parking lot surfaces only. 8. Subsequent development remains subject to all applicable Collier County Land 0evelopment Code requirements. SECTION TWO: This Ordinance shall become effective upon filing with the Department of State.
