Ordinance 96-20 ORDINANCE NO. 96-. 20 AN ORDINANCE AMENDING ORDINANCE NUMBER 91-102, THE COLLIER C')UNTY LAND DEVELOPMENT CODE WHICH ESTABLISHED THE COMPREHENSIVE ZONING REGULATIONS FOR THE UNINCORPORATED AREA OF COLLIER COUNTY, FLORIDA, BY AMENDING THE OFFICIAL ZONING AT~S ~P N~BER 9511N BY CHANGING THE ZONING C~SSIFICATION OF THE HEREIN DESCRIBED PROPERTY LOCATED ON THE WEST s~ o~ ~o~ ~o~ (c.~.~). ~o~T~ o~ PINE RIDGE ROAD (C.R. 896) IN SECTION 11, TOWNSHIP 49 SOUTH, ~NGE 25 EAST, COLLIER COUNTY, FLORIDA, FROM "I" TO "C-4" FOR AN STA[F AND P~NNING CO~ISSION STIPU~TIONS; AND BY PROVIDING AN EFFECTIVE DATE. WHEREAS, Blair Foley of Coastal Engineering Consultants, Inc., representing Jonathan R. Myers of Naples Dodge, Inc., , petitioned the Board of County Commissioners to change the zoning classification of th~ herein described real property; NOW, THEREFORE BE IT ORDAiNED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION ONE: The zoning classification of the real property as more particularly described by Exhibit "A", attached hereto and incorporated by reference herein, and located in Section 11, Township 49 South, Range 25 East, Collier County, Florida, is changed from "I" to "C-4" and the Official Zoning Atlas Map Number 9511N, as described in Ordinance 91-102, the Collier County Land Development Code is hereby amended accordingly. The herein described real property is the same for which the fezone is hereby approved subject to the following conditions: A. Arterial level street lighting shall be required at the project entrance. Site lighting shall be configured such that there shall be no glare or interference with motorists night vision on the adjacent arterial roadway. B. The applicant shall present evidence of a positive drainage outfall. Such outfall shall include any historical roadway drainage to be accommodated by the applicant as part of the overall water management plan for the site. C. The existing sidewalk may be required to be relocated to the west as a consequence of the future six-laning of Airport Road. The applicant shall be requested to provide additional right-of-way or an easement to accommodate this potential relocation. D. The joint access point proposed with Pine Air Lakes PUD shall be subject to access constraints consistent with the Collier County Access Management Policy. Such constraints include right-in/right-out access. The access location may also qualify for a northbound directional left turn in. The applicant shall be solely responsible for the construction of any median modifications requested or required. Nothing in this stipulation shall serve to operate as vesting any right-in median opening to the applicant. E. Ordinance 93-64 requires that a southbound turn lane be constructed to accommodate right turns into the site. The applicant shall be solely responsible for the construction of this turn lane. F. The applicant shall be required to construct/ recQnstruct sidewalks for the entire length of the site frontage along Airport Road. G. At the time of site development plan review, the Master Plan shall be revised to indicate where Corporation Boulevard will terminate. This will require a vehicular turn-around that meets County standards. , H. Landscaping and buffering shall be provided on-site in accordance with Division 2.4 of Collier County Land Development Code. I. The existing access points at Corporation Boulevard shall be closed (abandoned) upon the granting of this rezone petition. J. Prior to the issuance of any certificate of compliance the requirements set forth in Paragraphs A through I herein shall be in place or evidence of same shall have been granted to the County and the County shall have approved same. SECTION TWO: This Ordinance shall become effective upon filing with the Department of State.
