WHEREAS, the Board of County Commissioners adopted the Collier Coun~ Growt~
Management Plan on January 10, 1989; and
WHEREAS. Collier County has held public headngs to provide for and encourage public
participalion throughout the 1996-97 plan amendment process; and
WHEREAS, Collier County did submit the 1996-97 Growth Management Plan Amendments
Io the Department of Community Affairs for preliminary review on April 29, 1997; and
WHEREAS, the Department of Community Affairs did review and make written objections Io
Public Facilities Element/SANITARY SEWER Sub-Element Amendments Io the Growth
Management Plan and transmitted the same in wdting to Collier County within the time provided
by law; and
WHEREAS, Collier County has 120 days from receipt of the written objections from the
Department of Community Affairs to adopt, adopt with changes or not adopt the proposed Public
Facilities Element/SANITARY SEWER Sub-Element Amendments to the Growth Management
Plan; and
WHEREAS, the Board of County Commissioners of Collier County did take action in the
manner prescribed by law and did hold public headngs concerning the adoption of the Public
Facilities Element/SANITARY SEWER Sub-Element Amendments to the Growth Management
Plan on October 28, 1997; and
WHEREAS, all applicable substantive and procedural requirements of law have been met;
and
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, Ihat:

ELEMENT/SANITARY SEWER SUB-ELEMENT OF THE GROWTH
MANAGEMENT PLAN.
This Ordinance as described herein, shall be known as the 1997 Public Facilities
Element/SANITARY SEWER Sub-Element Amendments to the Growth Management Plan for
Collier County, Flodda. The Collier County Growth Management Plan Public Facilities
Element/SANITARY SEWER Sub-Element Amendment is attached hereto as Exhibit A and
incorporated herein by reference.
SECTION TW_Q: SEVERABILITY.
If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of
competent jurisdiction. such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the remaining portion.
S.~: EFFECTIVE DATE.
The effective date of this Amendment to the Public Facilities Element/SANITARY SEWER
Sub-Element shall be the date a final order is issued by the Department of Community Affairs or
Administration Commission finding the Element in compliance in accordance with Section
163.3184, Flodda Statutes, whichever occurs eadier. No development orders, development
permits, or land uses dependent on this Element may be issued or commence before it has
become effective. If a final order of noncompliance is issued by the Administration Commission,
this amendment may nevertheless be made effective by adoption of a Resolution affirming its
effective status, a copy of which Resolution shall be sent to the Depamnent of Community Affairs,
Bureau of Local Planning, 2555 Shumard Oaks Blvd., 3"' Floor, Tallahassee. Florida 32399-2100.

IMPLEMENTABLE SANITARY SEWER FACILITIES AND SERVICES
it- OBJECTIVE 1.1:
The County will implement the following policies to make certain that public and private sector sanitary
sewer service utilities provide, repair and/or replace sanitary sewer collection, treatment and disposal
facilities to correct existing deficiencies in their respective service areas, as may be required to meet
or exceed the Level of Service Standards established in this Plan. In addition, public sector sanitary
sewer service utilities will be expanded as necessary to provide for future growth.
~-Policy 1.1.1:
Continue the development of the Collier County Regional Sanitary Sewer System consistent with the
Capital Improvements element to sor~sting deficjencies an~provide for future growth.
Policy 1.1.2:
Consistent with the urban growth policies of the Future Land Use Element of this Plan, provision of
central ss'~itary sewer service by the Cou; ,y is limited to the service areas shown in this Plan and to
areas where the County has legal commitments to provide facilities and services as of the date of
adoption of this Plan.
Policy 1.1.3:
By the time mandated for the adoption of land development regulations pursuant to Chapter
163.3202, F.S., including any amendments thereto. the County will establish and implement a
program requiring that pdvate sector sanitary sewer service utilities establish and file with the Collier
County Utilities Division an annual statement of their policy and service criteria, including level of
service provided, consistent with the goals, objectives and policies of this Plan, for the expansion
and/or replacement of their facilities to correct existing deficiencies and provide for future growth
within their respective service areas. Also, County Ordinance 80-112 requires and new development
connecting to pdvate STP submit capacity availability information with building permit applications.
~ Policy 1.1.4:
Permit development of package sewage treatment plant systems only within the Designated Urban
Area of the Plan cn!y in areas where County wastewater service is not currently available, and allow
same only on an intedm basis until said County service is available. Allow individual septic systems
within the County only when connection to an existing central system is not readily accessible to
render service and note that where septic systems are allowed, and future County sewer service
becomes available, said septic systems will be required to connect to the County regional system.
Policy 1.1.5:
Continue enforcement of ordinances requiring connection of existing and new development to central
sanitary sewer systems when they become available. Connections to a central system shall be made
pursuant to Collier County Ordinance 88-4.

Policy 1.1.76:
The County will give planning and budgetary priority to regional sanitary sewer system projects which
will provide the means for phase out and connection of existing package sewage treatment plants and
areas of high concentrations of septic tanks where such facilities may reasonably be expected to
adversely affect public health and safety or the environment.
~-Policy 1.1.87:
Where Community Development Districts, or similar special districts are established to provide a tool
for developers to finance infra-structure or other purposes, wholly or partially within the Collier County
Water-Sewer District, sewer service will be connected to the regional system, and all facilities shall be
conveyed, when acceptable, to the Collier County Water-Sewer Distdct for operation and ownership in
accordance with Collier County Ordinance 88-76; the Utilities Standards and Procedures Ordinance.

The County will discourage urban sprawl and the proliferation of private sector sanitary sewer service
suppliers in an effort to maximize the use of existing public facilities through the development order
approval process by implementing the following policies.

Discourage urban sprawl by permitting central sanitary sewer systems only in the Designated Urban
Area of the Future Land Use Element of this Ptan, and in areas where the County has legal
commitments to provide facilities and service outside the Urban Area as of the date of adoption of this
Plan.

The County will discourage urban sprawl and the proliferation of private sector and/or package
sanitary sewer treatment systems through the development order approval process to insure
maxjmum utilization of the existing and planned public facilities. No existing pdvate sector or package
treatment system will be permirted to add customers unless all Levels of Service Standards are met.

Finally, and perhaps most importantly, the County must continue and expand efforts for conservation
of potable water supplies by increasing the use of treated wastewater effluent, or reclaimed water, for
irrigation use. The County has already made significant inroads in this regard by negotiating
agreements with area golf courses for the use of wastewater effluent for irrigation needs. This
program needs to be continued and expanded to promote effluent use wherever suitable. Further, the
County needs to develop an effective public information program promoting these efforts.
The above discussed recommendations are the basis of the Goals, Objectives and Policies presented
in the following section.
