Ordinance 97-25 ANCE NO. 97- RING THE COLLIER COUNTY S PLAN~ PROVIDING FOR INC REFERENCE INTO COLLIER COUNTY e RoviDiNG FOR CONSTRUCTION: IMPLEMENTATION OF STREETSCAPE MASTER PIll PROVIDING FOR FUTURE AMENDMENT OF STREETSCAPE MASTER PLAN; PROVIDING FOR CONFLICT AND SEVEPalLITYI PROVIDING FOR INCLUSION IN THE COD~ OF LAWS AND ORDINANCES, PROVIDING AN EFFECTIVE DATE. WHEREAS, the Board of County Commissioners of Collier County, Florida, authorized the development of a streetscape master plan for the major public rights-of-way in the urban area of Collier County in partnership with Collier/Naplescape '90si and WHEREAS, the Board received and reviewed a submission of the Collier County Streetscape Mas~'er Plan at its public meeting of December 17, 1996; and WHEREAS, said Master Plan may be considered a type of overlay design document for the urban area of Collier County, providing a plan for consistency throughout the County landscape program in major County public rights-of-way, including guidelines and a plant list that relates to the native character of the communityl and WHEREAS, the landscape plan is xeriphytic in nature in terms of reducing requirements for irrigation and maintenance for public rights-of-way landscape requirements; and WHEREAS, on December 17, 1996 the Board adopted Resolution No. 96- 589, acceptinq and adopting the Streetscape Master Plan with intention to implement said plan based upon elements of annual budget, funding sources and annual project reviewi and WHEREAS, the Board directed the preparation of an ordinance to ..e incorporate the Streetscape Master Plan by reference into the Collier County Land Development Code. NOW, THEREFORE BE IT ORDAINED by the Board of County Commissioners of Collier County, Florida: SECTION ONE: STREETSCAPE t~/STER PLAN ADOPTED, TO BE INCORPORATED BY REFERENCE INTO COLLIER COUNTY LAND DEVELOPMENT CODE. The Collier County Streetscape Master Plan is hereby adopted and shall be incorporated by reference into the Collier County Land Development Code (LDC) as a public road rights-of-way, median and required adjacent landscape buffer development and maintenance guideline. SECTION TWO: IMPLEMENTATION OF STREETSCAPEMA~TER PLAN The Collier County Streetscape Master Plan is to be construed and implemented in accordance with the LDC and other applicable county ordinances. SECTION THREE: FUTURE AMENDMENT TO STREETSCAPE MASTER PLAN. The Collier County Streetscape master Plan may be amended as determined by the Board. SECTION FOUR: CONFLICT AND SEVERABILITY. In the event this Ordinan.'e conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FIVE: INCLUSION IN THE CODE OF LAWS ~ ORDINANCES. The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be tenumbered or relettered to accomplish such, and the word "ordinance" may be changed to "section", "article", or any other appropriate word. SECTION SIX: EFFECTIVE DATE. Thfs Ordinance shall become effective upon filing with the Department of State.
