Ordinance 97-18 ORDINANCE NO. 97-1 I~ AN ORDINANCE AMENDING COLLIER COUNTY ORDINANCE NO. 92-102 WHICH CREATED THE COLLIER COUNTY PUBLIC GUARDIANSHIP PROGRAM; PROVIDING FOR AMENDMENT ' TO SECTION TWO, PURPOSE AND INTENT; PROVIDING FOR .,...,7.~1~;~.~.- AMENDMENT TO SECTION THEE, COLLIER COUNTY PUBLIC GUARDIANSHIP PROGRAM; PROVIDING F~ AMENDMENT TO SECTION FOUR, APPOINTMENTS TO PUBLIC GUARDIANSHIP PROGRAM; PROVIDING r-:, CONFLICT AND SEVERABILITY; PROVIDING FOR~ INCLUSION IN CODE OF LAWS AND ORDINANCES; AND~ PROVIDING AN EFFECTIVE DATE. ~ WHEREAS, on December 22, 1992, the Board of County Commissioners adopted County Ordinance No. 92-102 creating the Collier County Public Guardianship Program; and WHEREAS, the Board of County Commissioners desires to amend certain sections of this ordinance. NOW, THEEFORE, BE IT ORDAINlED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE: Amendment to SECTION TWO, of Collier County Ordinance No. 92-102. Section Two is hereby amended as follows: SECTION TWO: Purpose And Intent. It shall be the purpose of this ordinance to establish a Collier County office public guardian for the purpose of providing guardianship services for incapacitated persons when no private guardian is available for those persons whose needs cannot be met through less drastic means of intervention and to create a Collier County Public Guardianship Program. SECTION TWO: Amendment to SECTION THREE, of Collier County Ordinance No. 92402. Section Three is hereby amended to read as follows: SECTION THREE: Collier County Public Guardianship Program. There is hereby created the Collier County Public Guardianship Program under the authority and supervision of the office of Public Guardianship for Collier County. SECTION THEE: Amendment to SECTION FOUR of Co!iler County Ordinance No. 92-102. Section Four is hereby amended to read as follows: SECTION FOUR: Appointments To The Collier County Public Guardianship Program. All appointments to lhe Office of Public Guardian shall be made by administrative order and the Public Guardian for the Twentieth Judicial Circuit shall be appointed by the Chief Administrative Judge of the Twentieth Judicial Circuit. SECTION FOUR: Confilet And Severablllty. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall :pply. If any phrase or portion of the ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FIVE: In~!usion In The Code Of Laws And Ordinances. The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or relettered to accomplish such, and the word "ordinance" may be changed to "section", '"article", or any other appropriate word.
