PROVIDING AN EFFECTIVE DATE, WHEREAS, upon the incorporation of the City of Marco Island, the Board of County Commissioners has determined that it is in the best interests of the residents of Goodland and Hon's Island and the citizens of Collier County that a fire control district for and comprising the area known as Goodland and Horr's Island be created and established. NOW, THEREFORE, BE 1T ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIEK COUNTY, FLORIDA that: SECTION ONE: TITLE AND CITATION This Ordinance shall be known as the "Goodland / Horr's Island Fire Control District." SECTION TWO: BOUNDARIES OF THE DISTRICT The Goodland / Hort's Island Fir~ Control District is hereby created within the boundaries described as follows: That portion of Sections i 8 and 19, Township 52 South, Range 27 East, Collier County, Florida lying south of Goodland Bay, west of Coon Key Pass and north of Blue Hill Creek, commonly known as Goodland; AND That portion of "Horr's Island A.K.A. Key Marco" as recorded in Plat Book 21, pages 5 through 19, Public Records of Cotlier County, Florida, lying south of Blue Hill Creek. SECTION THREE: CREATION AND ESTABLISHMENT OF THE DISTRICT Pursuant to Section 12S.01, Florida Statutes, there is hereby created and established the Goodland / Horr's Island Fire Control District. SECTION FOUR: GOVERNING BOARD; POWERS AND DUTIES; A. The ~oveming board of the district shall be the Board of County Commissioners with the power and duty to conduct the affairs of the district with the powers prescribed by Section 12:5.01(1)(o,), Florida Statutes, including, but not limited to, the power to equip, operate and maintain fire department services within the district; to buy, lease, sell, exchange, or otherwise acquire, hold and dispose of equipment and other personal or real property; to employ and discharge employees and authorize them to enter upon private and public property at reasonable times to inspe.~'t, combat and investigate possible and actual fir~ Page I of 2 ; hazards and occun'cnccs; to pmrnul~ate rules and rcguT·lions for thc prcvcntion and control orfir~ and ~ ~hcrw~sc protccl pcnons and property within the district. B. SECTION FIVE: CONSTRUCTION: This Ordinance shall ~ h"~cPally conf, ru~ ,,o effectuate its public purple. SECTION SIX: INCLUSION IN THE CODE OF LAWS AND ORDINANCE The provi~ion~ of this Ordinanc~ shall become and be made a part of the Cxxie of Law~ and Ordinanc~ of Collier County, Florida. Th~ sections of lhe Ordinance may be TcnurnbcrtA or l~-Iclxcred f~ accomplish ~uch, and the word "ordinance" may be chang~ to "section," "article," or any ot/~r appropriate word. SECrlON SEVEN: CONFLICT AND SEVERABILITY In the ~vcnt this Ordinance conflicts with any other Ordinance of Collicr County or applicable law, the rnor~ r~trictive shall apply. If any phrase or portion of the Ordinanc~ is held invalid or unconsxitutional by My court of comp~ent jurisdiction, such portion shall be deemed a Icpara~ distinct and independent provision and such holding shall not affect tho validity of the rcmaining po~on. SECTION EIGHT: EFFECTIVE DATE This Ordinance shall become effective upon filing with the Department of Sla~.
