WHEREAS, the Board of County Commissioners of Collier County (h~'cinaf~r rely'red to
as the "Board"), on October 8, 1991, passed and duly adopted Collier County Ordinane~ No. 91-97
creating the Naples Production Park Street Lighting Municipal S~rvicc Taxing Unit for th~ pttrpos~
of providing street lighting within Section 36, Township 49 South, Range 25 East lying in Collier
County and, to that end, to possess all the powers to do all things reasonably nex;essary to provid~
such services, including ownership or r~ntal ofprope,'~'ty, poles, wires, conduits, lights, metm and
power to maintain the same and to enter into contracts for providing the sam~ and the e:l~tric cun'm~t
to operate: any lighting system therein installed; and
WHEREAS, the: Board, on D~ce:mber 1, 1981, passed and duly adopted Collier County
Ordinance: No. 81-79 creating the: Collier County Production Park Street Lighting Municipal Servic.~
Taxing Unit for the: purpose: of providing lighting to the: re:sid~-nts of the: Unit; and
WHEREAS, th~ Board, in ea~ly 1972, passed and duly adopted Collier County
No. 72-1 creating the: Collier County Lighting District; and
WHEREAS, the: Board, on March 28, 1989, passed and duly adopted Collier County
Ordinance: No. 89-21 repe:aling Ordinance: No. 81-79 and amending Ordinance: No. 72-1 by adding
certain e:xisting street lighting municipal service taxing unit's such as the: Collier County Production
Park Str~t Lighting Municipal Servic~ Taxing Unit to the Collier County Lighting District; and
WHEREAS, the Board, on March 24, 1987, passed and duly adopted Collier County
Ordinance: No. 87-1 i creating the Corporate Square Str~e:t Lighting Municipal Service: Taxing Unit
for the purpose: of providing stree:t lighting to ~s{deats of the: Municipal Service: Taxing Unit; and
WHEREAS, th~ Board, on February 13, 1990, passed and duly adopted Collier County
Ordinane~ No. 90-15 amending Collier County Ordinane~ No. 72-1 by adding the Corporate: Squar~
Sta'~t Lighting Municipal Service: Taxing Unit to th~ Collift County Lighting District; and
WHEREAS, th~ Board has de:termined that both Collier County Production Park and
Coq~oratc Square ~ included in th¢~ boundtries of Naples Production Park Street Lighting
Municipal Service Taxing Unit created by Ordinance No, 91-97 and that both areas by prior Board
action are already included within the Collier County Lighting District Ordinance No. 72-1; and
WHEREAS, the Board desires to remove the Collier County Production Park and Corporate
Square from the boundaries of the Naples Production Park Street Lighting Municipal Service Taxing
Unit.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
5.5~iD.J:L.O.~. AMENDMENT TO SECTION ONE OF ORDINANCE NO. 91-97 TO
CHANGE THE BOUNDARIES OF THE NAPLES PRODUCTION PARK STREET LIGHTING
MUNICIPAL SERVICE TAXING UNIT TO REMOVE THE COLLIER COUNTY PRODUCTION
PARK AND CORPORATE SQUARE FROM THE BOUNDARIES OF THE UNIT.
Section one of Collier County Ordinance No. 91-97 is hereby amended to exclude the
following two areas from the boundaries of the Municipal S~'vice Taxing Unit:
A. Commencing at the southeast comer of Section 36, Township 49 South, Range 25
East, Col|ier County, Florida, run N 00° 1 5'42'' E along the east line of said Section
36 a distknce orS0.0[ feet to a point on the northerly right-of-way line of Radio Road
and the Point of Beginning; thence continue N 00~15'42' E 1924.60 feet; thence S
89°18'34' W 200.00 feet; thence N 00°15'42'' E 54.55 feet; thence S 89~18'34' W
60.00 feet to a Point of Curvaturo of a non-tangent curve; thence 38.85 feet along the
arc of a curve, concave to the northwest, having a radius of 25.00 feet and subtended
by a chord having a l~ngth of 35.06 feet and bearing S 44e47'08'' W to a Point of
Tang~ncy; thence S 89°18'34' W 279.51 feet to a Point of Curvature; thence 39.(55
feet along the arc of a curve, concave to the northeast, having a radius of 25.00 feet
and subtended by a chord having a length of 35.62 feet and beaxing N 45~15'29'' W to
a non-tangent line; thence S 88e35'14'' W 60.03 feet to a Point of Curvature of a non-
tangent curve; thence 38.89 feet along the arc of a curve, concave to the northwest,
having a radius of 25.00 feet and subtended by a chord having a length of 35.09 feet
and bearing S 44°44'31'' W to a Point of Tangency; thence S 89"1 8'34'' W 339.14
feet to a Point of Curvature; thence 39.61 feet along the arc of a curve, concave to the
northeast, having a radius of 25.00 feet, and subtended by a chord having a length of
35.59 feet and bearing N 45°18'09'' W to a non-tangent line; thence S 88"40'26'' W
60.02 feet; thence N 00°05'08'' E 437.36 feet; thence N 89~54'55'' W 220.55 feet;
thence S 00~05'08'' W 525.00 feet; thence N 89"1 8'34'' E 195.21 feet to a Point of
Curvature; thence 39.6I feet along the arc of a curve, concave to the southwest,
having a radius of 25.00 feet and subtended by a chord having a length of 35.59 feet
and bearing S 45~18'09'' E to a non-tangent line; thence N 88'39'02'' E 60.02 feet to
a Point of Curvature of a non-tangent curve; thenco 38.93 feet along tho aro of a
curve, concavo to the southeast, having a radius of 25.00 feet and subtended by a
chord having a length of 35,12 feet and bearing N 44°41'51'' E to a Point of
Tangency; thence N 89~18'34'' !! 338.97 feet to a Point of Curvature; thence 39.65
feet along the arn of a curve, concave to the southwest, having a radius of 25.00 feet
and subtended by a chord having a length of 35.62 feet and bearing S 45~15'29'' E to
a Point of Tangency', thence S 00Q10'28'' W 603.27 feet; thence S 89° 1 6'06'' W 10.00
feet; thence S 00°10'28" W 1267.31 feet to the northerly fight-of-way line of radio
Road (C-858); thence N 89Ql l'10'' E along said right-of-way line a distance of
656.57 feet to the Point of Beginning.

Public Records of Collier County, Florida; all being a pan of Section 36, Township 49
South, Range 25 East, Collier County, Florida, containing 37,92 acres more or less,

The provisions of this Ordinance shall become and be made a part of the Code of Laws and
Ordinances of Collier County, Florida. The sections of the Ordinance may be tenumbered or
reletterexi to accomplish such, and the word "ordinance" may be changed to "section", "article", or
any other appwpriate word.
S.v~/ICZILT,'d~. CONFLICT AND SEVERABILITY
In the event this Ordinance conflicts with any other ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent pwvision and such holding shall not affect the validity of the
remaining portion.
~. EFFECTWE DATE
This Ordinance shall become effective upon filing with the Florida Department of State of
State.
