Ordinance 98-056 ORDINA CE O. ga-_sf _ ORDINANCE REPEALING COLLIER COUNTY ORDINANC NO. 88-28, AS ~ENDED, ~tICH ESTABLISHED THE MARCO' ISLAND BEAUTIFICATION ADVISORY COMMI~EE;:- PRODDING FOR INCLUSION IN THE CODE OF LAWS O~INANCES; PROVIDING FOR CONFLI~ AN~ SEVE~BILI~; AND PRODDING ~ E~I~ DATE. WHEREAS, on July 21 1981, the Board of County Commissioners adopted Ordinance No. 81-35 creating the Marco Island Beauti~cation Municipal Service Tax Unit; and WHEREAS, on March 1, 1998, the Board of County Commissioners adopted Ordinance No. 88-28, which established the Marco Island Beauti~cation Advisory Committee; and WHEREAS, on April 14, 1992, the Board of County Commissioners adopted Ordinance No. 92-21, which mended Ordinance No. 88-28; and WHEREAS, on August 28, 1997, the City of Marco Island voted to incorporate; and WHEREAS, on March 30, 1998, the City of Marco Island terminated the Marco Island Beauti~cation Municipal Service Taxing Unit by City Resolution No. 98-3-30A; and WHEREAS, on May 26, 1998, the Board of County Commissioners adopted Ordinance No. 9842, repealing Ordinance No. 81-35 and abolishing the Marco Island Beauti~eation Municipal Service Tax Unit. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE: Repeal of 0rdinance No. 88-28, as amended. Collier County Ordinance No. 88-28, as amended, is hereby repealed in its entirety. SECTION TWO: Conflict and Severability. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION THREE: Inclusion In The Code Of Laws And Ordinances. The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinances may be renumbered or rclcttcred to accomplish such, and thc word "ordinance" may bc changed to "section," "article," or any other appropriate word. SECTION FOUR: Effective Date. This Ordinancc shall take effect upon filing with thc Dcpartmcnt of Statc.
