AN ORDINANCE AMENDING ORDINANCE NUMBER
91 - 102, THE COLLIER COUNTY LAND DEVELOPMENT
CODE WHICH ESTABLISHED THE COMPREHENSIVE
ZONING REGULATIONS FOR THE UNINCORPORATED
,.-.- AREA OF COLLIER COUNTY, FLORIDA, BY AMENDING
THE OFFICIAL ZONING ATLAS MAP NUMBER 8523S BY
CHANGING THE ZONING CLASSIFICATION OF THE
HEREIN DESCRIBED PROPERTY LOCATED ON THE
NORTH SIDE OF PIPER BOULEVARD IMMEDIATELY
WEST OF CYPRESS WAY, FURTHER DESCRIBED AS
BLOCK B, PALM RIVER ESTATES UNIT 4, IN SECTION
23, TOWNSHIP 48 SOUTH, RANGE 25 EAST, COLLIER
COUNTY, FLORIDA, FROM C-1 TO C-3; PROVIDING
FOR STAFF AND PLANNING COMMISSION
STIPULATIONS; AND BY PROVIDING AN EFFECTIVE
DATE.
WHEREAS, Richard D. Yovanovich of Goodlette, Coleman & Johnson, P. A.,
representing Naples Dinner Theatre, Ltd., petitioned the Board of County Commissioners to
change the zoning classification of the herein described real property;
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA:
SECTION ONE:
The zoning classification of the real property as more particularly described by Exhibit
"A", attached hereto and incorporated by reference herein, and located in Section 23,
Township 48 South, Range 25 East, Collier County, Florida, is changed from C-1 to C-3 and
the Official Zoning Atlas Map Number 85235, as described in Ordinance 91-102, the Collier
County Land Development Code is hereby amended subject to the following conditions:
1. Uses Permitted:
a. All of the principal and accessory listed uses pursuant to Section 2.2.12.2.1.
and 2.2.12.2.2. (C-1 Commercial Professional District).
b. Dinner theaters.
2. Development Standards:
a. No building shall exceed a height of thirty-five (35) feet.
SECTION TWO:
This Ordinance shall become effective upon filing with the Department of State.
