Ordinance 99-10 ORDINANCE NO. 99-10 AN ORDINANCE AMENDING PARAGRAPH A OF SECTION FIVE OF ORDINANCE NO. 95-67, THE AIRPORT AUTHORITY ORDINANCE, TO ELIMINATE THE ABSOLUTE LIMITATION ON THE NUMBER OF TIMES A MEMBER OF THE AUTHORITY MAY BE REAPPOINTED TO THE AUTHORITY PROVIDED THE SPECIFIC MEMBER'S EXTENDED REAPPOINTMENT IS APPROVED BY UNANIMOUS VOTE OF THE BOARD OF COUNTY COMMISSIONERS; PROVIDING FOR INCLUSION INTO THE CODE OF LAWS AND ORDINANCES; PROVIDING AN EFFECTIVE DATE. WHEREAS, paragraph A of Section FIVE of Ordinance No. 95-67 (the Airport Authority Ordinance) limits the number of times that a member of the Airport Authority may be re- appointed to the Airport Authority; and WHEREAS, the Airport Authority has requested that the Board of County Commissioners delete from Ordinance No. 95-67 limitations on the number of times a member of the Authority may be re-appointed to the Authority; and WHEREAS, because the Airport Authority functions much like a Board of Directors of a corporation, the Board finds that it does not necessarily promote the public interest to limit the number of times members of the Authority may be reappointed to membership of the Authority. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORID& as follows: SECTION ONE. AMENDMENT TO SECTION FIVE OF COLLIER C(II~_TY ORDINANCE NO. 95-67. Paragraph A of Section FIVE of Collier County Ordinance i~95~, 67 is hereby amended to read as follows: SECTION FIVE. GOVERNING BODY; MEMBERSHIP, APPOINTMENT, TERMS OF OFFICE. A. In the event this Ordinance conflicts with any other ordinance of Collier County, this ordinance shall prevail. If any section, phrase, sentence or portion of this ordinance is for any reason held -"- invalid or unconstitutional by any court of comPetent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions thereof. SECTION THREE. INCLUSION IN THE CODE OF LAWS AND ORDINANCES. The previsions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be renurnbered or relettered to accomplish such, and the word "ordinance" may be changed to "section", "article", or any other appropriate word. SECTION FOUR. EFFECTIVE DATE. This Ordinance shall become effective upon filing with the Department of State.
