RESOLUTION NO. 95 -556
RESOLUTION AUTHORIZING FINAL ACCEPTANCE OF THOSE
ROADWAY, DRAINAGE, WATER AND SEWER IMPROVEMENTS IN
LELY RESORT PHASE ELEVEN, RELEASE OF THE MAINTENANCE
SECURITY, AND ACCEPTING THE MAINTENANCE
RESPONSIBILITY FOR THE ROADWAY, DRAINAGE, WATER AND
SEWER IMPROVEMENTS THAT ARE NOT REQUIRED TO BE
MAINTAINED BY THE HOMEOWNERS ASSOCIATION.
WHEREAS, the Board of County Commissioners cf Collier County,
Florida, on J\;ne 28, 1994 approved the plat of Lely Resort Phase
Eleven for recording; and
WHEREAS, the developer has constructed and maintained the
roadway, draillage, water and sewer improvements 5n accordance with
the approved lllans and specifications and as req\.lired by the Land
Development C0de (Collier County Ordinance No. 91-102, as amended) i
and the utili ies Standards a: d Procedures Ordin, nce (Collier
County OrdinarJce No. 88-76, a~ amended), and
HHEREAS, the developer h s now requested fi al acceptance of
the roadway, Jrainage, water nd sewer improveme ts and release of
his maintenan::e seCL:r i ty; and
WHEREAS, the Compliance ervices Section of Development
Services Department has inspel.ted the roadway, d~ainage, water and
sewer Lllprovemcnts and is recommending acceptance of said
facilities.
NON, THEREFORE, BE IT RESOLVED BY THE BOARe OF COUNTY
COMMISSIONERS :)f' COLLIER COUNTY, FLORIDA, that f ._nal acceptance be
granted for those road'Ylay, dr inage, water and s -'wer improvements
in Lely Resort Phase Eleven, nd authorize the Cerk to release the
maintenance security.
BE IT FURTHER RESOLVED 1D ORDERED that the County accept the
future mainterlnce and otherttendant costs for the roadway,
drainage, l/ater and sewer improvements that are not required to be
maintained by the homeowners association.
This Resolution adopted after motion, secor I. and majority vote
favoring same.
