RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA
DETERMIHG THAT REVISIONS TO THE PELICMI
MARSH DBVELOPMEH'l' ORDER 95-1 00 NOT
CON1TITUTE A SUBSTANTIAL DEVIATION
REQ~IRING FURTHER DEVELOPMENT OF,REGIONAL
IMPACT REVIEW.
WHEREAS, the Board ot County Commissioners ot CoLlier County,
Florida, approved Jevelopment Order. 95-1 (the Development Order) on
January 24, 1995, which approved a Development ot Reg '.onal Impact (DRI)
known as Pelican Marsh; and
WHEREAS, Sect-ion 380.06(19) (t)2, Florida Statute,:..&. requires that
~roposed changes to a previously a~proved Development ot Regional
Impact (DRI) be submitted by the developer to the local government, the
regional planning council, and the state land planninl agency; and
WHEREAS, submittal of the proposed changes was m:~de to the
\ppropriate public authorities; an
WHEREAS, Section 380.06(19)(t,5, Florida Statute~, requires that
the local go"ernmer.;~ ahall determi.e whether or not the proposed change
to the previously approved DRI development order constitutes a
.ubatantial deviation requiring turther Development-o:-Regional-Impact
~eview ; and
WHEREAS, the B"ard ot County ommissioners ot Co '. lier County has
reviewed and considered the report and recommendation. ot the Southwest
"
Florida Regional planning Council ,SWFRPC) and on September 26, 1995
}.eld a public hearing on the petition; and
. WHEREAS, by se,larate action the Board ot County (.ommissioners will
cause Pelican Marsh POD Developmenc Order to be amended to reflect the
'lroposed revisions which do not constitute a substantj al deviation

NOW, THEREFORE, be it resolved by the Board of County
commissionerB ot collier County, Florida that:

The proposed revisions to pelican Marsh Development Order
95-1, as described in Petition OOA-95-2, noted as Exhibit "A"
and heroto mace a part of this Resolution do not constitute a
substantial duviation requiring further Development-of-
Regional-Impact review.
