RESOLUTION FOR PETITION AV 95-008 TO VACATE A 20 FOOT
ALLEYW'AY AND PORTIONS OF 8 PERIMETER DRAINAGE AND UTILITY
EASEMENTS LOCATED ON A PORTION OF BLOCK 219, ON THE PLAT OF
COLDEN GATE UNIT 6. AS RECORDED IN PLAT BOOK 5, PAGES
124-126, OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA.
WHEREAS, pursuant to Sections 177.101, 336.09 and 336.10, Florida Statutes.
Bill Hoover, of Hoover Planning Shoppe. as agent for owners. \li11i4111 V. and
Sheila M. Coppola; John T. Hagocs and Ann Long; Joseph and Catherine Trupiano;
Robert and \lilliam Davidson; Darryl Damico and Leonard Svirda; and Sid Skidmore,
do hereby request tb vacation of a 20 foot alleyway and portions of 8 perimeter
drainage and utility ease..nts located on a portion of the plat of Golden Gate
Unit 6, as recorded in Plat Book 5. Pages 124-126, of the Public Record.s of
Collier County, Florida; and
WHEREAS, Co111t c County Transpor aelon Service. propo". exp.nding the
alleyway segment to {nclude the segment as shov4 on Attachment 1; and
WHEREAS, the Board on its own motif n desire. to expand tho alleyway .egment
to include the segment on Attachment 1; ~nd
WHEREAS, the Board has this day he..d a public hearing to consider vacating
a portion of said plat as 80re fully described below, and notice of .aid public
hearing to vacate va. given as required by lav; and
WHEREAS, the granting of the v ;ation vill not adv.,:sely affect the
ownership or right of convenient access )f other property owne~'8.
WHEREAS, the petitioner is request 19 vacation of the public ingress/egres8
rights to the 20 fOOl alleyway, but the public shall retain the public utility
and drainage rights vith no maintenance responsibility by ColI er County.
WHEREAS, the vacation and abandonment of the 20 foot all."",ay on a portion
of the plat of Golden Gate Unit 6, as r ~orded in Plat Book 5, Pages 124-126, of
the Public Records of Collier County, orida, would benefit he general public
welfare and is in the best interest of 1e public in the foll~ing particular.:
1. yetitioner agree. to clear and maintain the alley area improving
aesthetics.
NOW', THEREFORE. BE IT RESOLVED B THE BOARD OF COUNTY COHKISSIONERS OF
COLLIER COUNTY, FLORIDA, that the follo\ ing be and is hereby vacated:
The public ingress/egress rights 4: d the drainage and utllity easements as
described in Exhibits -A- and "B" attached to and incorporatt"d herein.
