Resolution 1995-526 .,1 RESOLUTION 95-~ A RESOLUTION PROVIDING FOR THE ESTABLISHMENT OF ESSENTIAL SERVICES CONDITIONAL USE IN THE "A-MHO" ZONING DISTRICT PURSUANT. TO SECTION ~ .6.9.2 OF THE COLLIER COUNTY LAND nEVELOPMENT '.~ODE FOR PROPERTY LOCATED IN SECTIONS 9 & 4, 'rOWNSHIP 47 SOUTH, RANGE 29 EAST, COLLIER COUNTY, FLORIDA. WHEREAS, ttle Legislature of the State of Flor;.da in Chapter 67-1246, Laws 0' Florida, and C~\apter 125, Florida Statutes, has conferred on Collier County the power to establish coordinate and enforce zoning .nd such busines; regulations as ar: necessary for the ." ;,~ (,J j 1 "/ r, :I~,..,'.l, :~ \; , , ~.1 . .... J'" ...:.J: protection of the public; and WHEREAS, telo County pursua'",t thereto has adop"ed a Land Development Code (Ordinance No. 91-102) which includes a Comprehensive Zoning Ordinance establishing regulations for the :oning of particular geographic divis~"ons of the County, among which 11 the granting of Conditional Uses; and WHEREAS, the Collier Count Planning Commissil;n, being the duly appointed and co",stituted plann ng board for the area hereby affected, has held a public hearing after notice as in said regulations made and provided, and has considered the advisability of a; Essential Services Conditional Use pursuant to Section 2.6.9.2 in an I ~-MHO" zone for the expansion of the existing water tr~atment facility ~n the property hereinafter described, and has ,und as a matter 01 fact (EXhibit "A") that satisfactory provision and !rrangement have besn made concerning all applicable matters required by said regulation! and in accordance with Subsection ~,.7.4.4 of the Land Development Cod! for the Collier County Planning commission; and WHEREAS, all interested parties have been give'1 opportunity to be heard by this Boa:.:-d in a public ineeting assembled a'ld the Board havinq considered all matters presented. NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF ZONING APPEALS of Collier County, lorida that: -1- The petition filed by Bill Hoover of Hoover Planninq Shoppe, representing the Immokalee Water & Sewer District with respect to the property hereinafter described as: Exhibit "B" which is attached hereto and incorporated by reference herein ~~ be and the same is hereby approved for an Essential Services Conditional Use pursuant to Section 2.6.9.2 of the "A-MHO" zoning district for th! expansion of the existing water t~eatment facility in accordance with the Conceptual Master Plan (EXhibit "C") and subject to the following conditions: Exhibit "t'" which is attac'led hereto and inco 'porated by reference ~erein.
