RESOLUTION NO. 95 -516
RESOLUTION AUTHORIZING FINAL ACCEPTANCE OF THOSE
ROADWAY, DRAINAGE, WATER AND SEWER IMPROVEMENTS IN
LELY BAREFOOT BEACH UNIT FOUR, RELEASE OF THE
MAINTENANCE SECURITY, AND ACCEPTING THE MAINTENANCE
RESPONSIBILITY FOR THE ROADWAY, DRAINAGE, WATER AND
SEWER IMPROVEMENTS THAT ARE NOT REQUIRED TO BE
MAINTAINED BY THE HOMEOWNERS ASSOCIATION.
WHEREAS, the Board of County Commissioners of Collier County,
Florida, on January 16, 1990 approved the plat of Lely Barefoot
Beach unit Four for recording; and
WHEREAS, the developer has constructed and maintained the
roadway, dzainage, water and sewer improvements in accordance with
the approvE.d plans and specifications and as required by the Land
Development Code (Collier County Ordinance No. 91-102, as amended);
and the Utilities Standards and Procedures Ordinance (Collier
County Ordjnance No. 88-76, as amended), and
WHEREPS, the developer has now requested final acceptance of
the roadway, drainage, water and sewer improvements and release of
his ma inter' lnce security; a,d
WHEREAS, the Complianc '! Services Section )f Development
Services Department has ins,)ected the roadway, drainage, water and
sewer imprcvements and is I!commending acceptalce of said
facilities.
NOW, 'THEREFORE, BE IT .1ESOLVED BY THE BOA,m OF COUNTY
COMMISSIONERS OF COLLIER CO~~TY, FLORIDA, that final acceptance be
granted for those roadway, drainage, water and sewer improvements
in Lely Barefoot Beach Unit Four, and authorize the Clerk to
release the maintenance security.
BE IT FURTHER RESOLVED AND ORDERED that tile County accept the
future maintenance and othE' . attendant costs f:lr the roadway,
drainage, water and sewer i ,provements that ar'.! not required to be
maintained by the homeowner association.
