RESOLUTION NO. 95- 505 RESOL~rION OF THE BOARD OF COUNTY COMMISSIONERS, COLLIER COUNTY, FLORIDA, AUTHORIZING WAIVER OF LIBRARY SYSTEM IMPACT FEES, PARKS AND RECREATIONAL FACILITIES IMPACT FEES, ROAD IMPACT FEES, EMERGENCY MEDICAL SERVICES IMPACT FEES AND EDUCATIONAL FACILITIES SYSTEM IMPACT FEES FOR ONE HOUSE TO BE CONSTRUCTED BY IMMOKALEE HABITAT FOR HUMANITY, INC. ON LOT 11, HIGHLANDS HABITAT SUBDIVISION, IMMOKALEE. WHE~EAS, Collier County has recognized and attempted to address the lack of adequate and affordable housing for moderate, low, and very'low income households in the County and the need for creative dnd innovative programs to assist ~n the provision of such housi'1g by including several provisions in the Collier County Growth Management Plan including: objec~ive 1.4, policy 1.4.1; objective 1.5, policy l.5.2, policy 1.5.., policy 1.5.4, policy 1.5.5, policy 1.5.6: objective 1.6, policy 1.6.3; objective 2.1, policy 2.1.1, ,)olicy 2.1.2, po lilY 2.1.3, policy 2.1.5, and policy 2.1.6 of the Housing Element; and WHEREAS, Collier County has received fundin~' pursuant to the State Housing Initiatives Partnership progran set forth in Section 420.907 et. seq., FJ )rida Statutes and Chapter 91-37, Florida Administrative Code; Id WHEHEAS, '.n accordance ith Collier County Ordinance No. 93-19, the County is authorized to use funding from the State Housing Initiatives Partnership [SHIP] Program for waivers of Collier County impact fees; ani WHEREAS, rmmokalee Habit t for Humanity, IT ~. is seeking a waiver of impact fees; and WHEREAS, Inmokalee Habito ~ for Humanity, Inc. will construct one (1) three-bedroom unit (the "Dwelling Uni"") on Lot 11, Highlands Habi.;at SUbdivision, Immokalee which is proposed to . sell for Forty-Six Thousand dve Hundred Dollars ($46,500.00); and WHEREAS, the Dwelling Uni t will be purchase'.! by a very low income household which is required to invest a rninimum of five 601K nco PAG~ 430 hundred (500) hours of "Sweat Equity" before it obtains title to the house; and WHEREAS, J'[r. Charles C. Smith, Vice President of Immokalee Habitat for Humanity, Inc., submitted to the Office of Housing and Urban Improvement. an Affordable Housing Application dated August 23, 199~) for a waiver of impact fees for the construction of a house on I~t 11, Highlands Habitat Subdivision, Immokalee, a copy of said application is on file in the Housing and Urban Improvement Department; and WHEREAS, in accordance with Section 3.04 of the Library System Impact Fee Ordinance, Ordinance No. 88-97, as amended; Section 4.05 0f the Parks and Recreational Facilities Impact Fee Ordinance, Ordinance No. 88-9'i, as amended; Sec'ion 3.04 of the Road Impact ./ee Ordinance, Ordinance No. 92-2, as amended; Section 3.05 111: the Emergency Medical Services S.rstem Impact Fee Ordinance, Ordinance No. 91-71, as amended; and Section 3.05 of the Educational Facilities System Impact Fee Ordinance, Ordinance No. 92-33, as a.mended; an appl icant may obtain a 'Naiver of impact fees by qualifying for a wai VI C'; and WHEREAS, Immokalee Habit.t for Humanity, Ire:. has qualified for an impact fee waiver basel upon the following representations made by Immokalee Habitat for Humanity, Inc.: A. The Dwelling unit shall be sold to a first-time home buyer. B. The Dwelling unit t .all be sold to a lousehold with a very low income Ie' ~l as that term L defined in the Appendices to the r 'specti ve Impact Fee Ordinances and the monthly payment to purchase the unit must be within the !ffordable housing guidelines est:1blished in the Appei ,dices to the r', 3pecti ve Impact Fee Ordinances. C. The Dwelling unit stall be the Homestead of the owner. D. The ))welling unit s..1all remain afford.'ble for fifteen (15) years from the date the certif ic" te of occupancy is iflsued. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1. The Board of County Commissioners hereby authorizes the County Manager to issue an Authorization for waiver of impact fees to Immokalee Habitat for Humanity, Inc. for one (1) house which shall be constructed on Lot 11, Highlands Habitat Subdivision, Immokalee, Collier County, Florida. 2. Upon receipt by the Housing and Urban Development Dire :tor of an agreement for waiver of impact fees signed by Immokalee Habitat for Humani~:y, Inc., and/or the ?urchaser, or ot'ler documentation acceptable to the County Attorney, t' e Board of Count { Commissioners hereby authorizes tl ~ payment by Colli, r County of the following impact feed from the Affordab'.e Housing Trust Fund, Fund (191), ill the following amo\nts for the one (1) house to be built on Lot 11, Highlands Habitat SUbdivision, Immokalee by Immokale ~ Habitat for Humanity, Inc.: A.
