RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA,
AUTHORIZING PAYMENT OF REGIONAL WATER SYSTEM
IMPACT FEES, REGIONAL SEWER SYSTEM IMPACT
FEES, LIBRARY SYSTEM IMPACT FEES, PARKS AND
RECREATIONAL FACILITIES IMPACT FEES, ROAD
IMPACT FEES, EMERGENCY MEDICAL SERVICES SYSTEM
IMPACT FEES AND EDUCATIONAL FACILITIES SYSTEM
IMPACT FEES FOR ONE HOUSE TO BE CONSTRUCTED BY
IMMOKALEE HABITAT FOR HUMANITY, INC. ON LOT

WHERE^S, Collier County has recognized and attempted to
address th~ lack of adequate and affordable housing for moderate,
low, and very-low income households in the County and the need
for creati 'Ie and inno'lath 9 programs to assi.:;t in the provision
of such hC'using by incluc~ng several proviso ons in the Collier
County Grc",th Management i'lan, including: ot jective 1.4, policy
1.4.1; obj!!ctive 1.5, pol. '=y 1.5.2, policy 1.5.3, policy 1.5.4,
policy 1. 5.5, policy 1. 5.6; objective 1. 6, policy 1. 6. 3;
objective 2.1, policy 2.1.1, pOlicy 2.1.2, policy 2.1.3, pOlicy
2.1. 5, and policy 2.1. 6 of the Housing Elemen'; and
WHEREAS, Collier Coun'y has received fun,:ing pursuant to the
State Housing Initiative. Partnership PrOt'ram set forth in
Section 42('.907 et. seg., Florida Statutes and Chapter 91-37,
Florida Administrative Code; and
WHEREAS, in accordance with Collier Cl, Jnty Ordinance No.
93-19, the County is authorized to use funC: lng from the State
Housing Initiatives Partr, rship [SHIP] prog am for waivers of
Collier COU.lty impact fees and
~~EREAS, Immokalee H~ litat for Humanity, Inc. is seeking a
waiver of impact fees; and
WHEREA i, Immokalee Habitat for Humanity, Inc. will construct
one (1) thr,!e-bedroom unit (the "Dwelling Unit") on Lot 43, Block
11, Naples Manor Extension, Naples, Florida which is proposed to
sell for Forty six Thousand Five Hundred Dollars ($46,500.00);
and

WHEREAS, the Dwel1inq Unit will be owned by a very low
income household, and
WHEREAS, Mr. Charles C. Smith, Executive Vice President of
Immokalee Habitat for Humanity, Inc., submitted to the County
Manager's Office an Affordable Housing Application dated May 26,
1995 for a waiver of impact fees for the construction of a house
on Lot 43, Block 11, Naples Manor Extension, Naples, Florida, a
copy of s lid application is on file in th(J Housing and Urban
Improvement Department; and
WHEREAS, in accordance with Section 3.04 of the Regional
Water Sys':;em Impact Fee ordinance, Ordinance No. 90-86, as
amended; Lection 3.04 of the Regional Sewel System Impact Fee
Ordinance, Ordinance No. ~0-87, as a~ended; Section 3.04 of the
Library S'.'stem Impact Fe! Ordinance, Ordir. lnce No. 88-97, as
amended; Flection 4.05 of the Parks and Recleational Facilities
Impact Fee Ordinance, Ordinance No. 88-96, as amended; Section
3.04 of th~ Road Impact Fee Ordinance, Ordinance No. 92-22, as
amended; Section 3.05 of the Emergency Med~:al Services System
Impact Fee Ordinance, Odinance No. 91-7', as amended; and
Section 3.05 of the Edu' ational Facili tie!' System Impact Fee
Ordinance, Ordinance No. 92-33, as amended; an applicant may
obtain ~ waiver of impact fees by qualifying for a waiver; and
WHEREAS, Immokalee Habitat for Humanity Inc. has qualified
for an impact fee waiver based upon the follo,'ing representations
made by Immokalee Habitat 'or Humanity, Inc.:

C. The Dwelling Unit shall be the Homestead of the owner.
D.
The Dwelling Unit shall remain affordable for fifteen
(15) years from the date the certificate of occupancy
is issued.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
CO~TSSIONERS OF COLLIER COUNTY, FLORIDA, that:
The Board of County Commissioners horeby authorizes the
~ounty Manager to issue an Authorization for waiver of
impact fees to Immokalee Habitat for Humanity, Inc. for
me (1) house which shall be constructed on Lot 43,
:'J1ock 11, Naples Manor Extension, Naples, Collier
:ounty, Florida.
