A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER ce. UNTY , FLORIDA, APPROVING THE ISSUA.~CE OF NOT
EXCEEDING $15,000,000 HOUSING FINANCE AUTHORITY OF
COLLIER COtJNTY MULTI-FAlULY REVENUE BONDS, SgRIES 1995

Section 1. Recital.. It is hereby founrt, ascertained,
determined and ~eclared that:
A. The Housing Finance Authority of Col1j er County (the
-Issuer-) is a ~'ub1ic corporatit-n of the State of F~_orida, was duly
created by Hom': Rule Ordinance No. 80-66 of the'Joard of County
Commissioners (,f Collier Count}, Florida, and is a body corporate
and politic duly created and ex~sting as a local gc'~ernmenta1 body
and a public instrumentality for the PUrpOSf of assisting
qualifying housing projects s1 tuated in Collier :ounty, Florida
(the -County.), under and by virtue of Chapter 159, Part IV,
Florida Statutes, (the -Act.), to provide for the issuance of and
to issue and sell its obligations for lawful corpG:ate purposes.
B. The Issuer has submitted to the Be .1rd of County
COmmissioners a copy of its Rf solution (the -Res')lution.), with
respect to the issuance by it or not to exceed $15, ,)00,000 Housing
Finance Authority of Collier t Junty Multi-Family Revenue Bonds,
Series 1995 (Garden Walk Vil1a~.! Project) (the .BC"lds.).
C. A pub) j,c hearing was ,eld on the Resolution on April 17,
1995, which pub'tic hearing was duly conducted by the Issuer upon
reasonable public notice, and at such hearing interested
individuals were afforded the opportunity to expre3S their views,
both orally and in writing, on all matters peJ t:aining to the
location and nature of the proposed project and to :he issuance of
the Bonds.
o. The Issuer has reco~ !nded and requesteo that the Board
of County Commic..Jioners approv,' the issuance of t}.'! Bonds so that
the interest or the Bonds wi 1 be exempt from federal income
taxation under applicable pro'isions of Section 147 (a) of the
Internal Revenue Code of 1986, IS amended.
E. The Resolution shows that the Issuer has acted in
accordance with all applicable requirements of 1a\v, and that the
issuance of the Bonds will serve significant pub~ic purposes as
provided in the ~ct.
F. The p~rpose of the Act will be effectively served,

G. The Bonds shall not constitute a debt, or a pledge of
faith and credit of the Issuer, the County, the State of Florida or
any political subdivision thereof, and neither the Issuer, the
County, the Stat.e of Florida nor any political subdivision thereof
shall be 1iabli! thereon; nor in any event shall the Bonds be
payable out of any funds or properties other than those of the
Issuer, and then only to the extent provided in the Indenture. No
member of the BlJard of County Commissioners or any officer thereof
shall be liable personally on the Bonds by reason of its issuance.
Section 2. Approval ot. Xssuance ot. t.he Bonds. The issuance
of the Bonds as contemplated by the Resolution is h~reby approved,
however this approval shall in no way be deemed to abrogate any
land deve1opme:lt regulations of the County an:t the project
contemplated by this resolution shall be subj ec t to all such
regulations, including, but not limited to, the (~unty's Growth
Management Plan and all concurrency requirements con .:ained therein.
Section 3, Repealing ClauJe. All resolution~J or orders and
parts thereof in conflict herewith, to the extent of such conflict,
are hereby supe rseded and repea' .ed.
Section". Bt.t.ective Date. This Resolution shall take effect
immediately upon its adoption.
