RESOLUTION NO. 95-388
RESOLUTION AUTHORIZING FINAL ACCEPTANCE OF THOSE
ROADWAY, DRAINAGE, WATER AND SEWER IMPROVEMENTS IN
LELY RESORT PHASE SIX, RELEASE OF THE MAINTENANCE
SE~JRITY, AND ACCEPTING THE MAINTENANCE
RES'?ONSIBILITY FOR THE ROADWAY, DRAINAGE, WATER AND
SEW€R IMPROVEMENTS THAT ARE NOT REQUIRED TO BE
MAI;{TAINED BY THE HOMEOWNERS ASSOCIATION.
WHEREAS, the Board of County Commissioners of Collier County,
Florida, on3eptember 22, 1992, approved the plat of Lely Resort
Phase six fo~ recording; and
WHEREAS, the developer has constructed and maintained the
roadway, dralnage, water and sewer improvements in accordance with
the approved plans and speci:~ications and as re'Juired by the Land
Development Code (Collier CCllnty Ordinance No. n-102, as amended);
and the utilities Standards ~nd Procedures Ordi lance (Collier
County Ordir ,mce No. 88-76, IS amended), and
WHEREAS, the developer has now requested f .nal acceptance of
the roadway, drainage, water and sewer improvem!nts and release of
his mainten<<nce security; a~u
WHEREAS, the Compliance Services Section of Development
Services Department has inspected the roadway, drainage, water and
sewer improvements and is recommending acceptar:e of said
facilities.
NOW, THEREFORE, BE IT I ;~SOLVED BY THE BOAP,' OF COUNTY
COMMISSIONERS OF COLLIER COt .rTY, FLORIDA, that ~_'inal acceptance be
granted for those roadway, c :ainaqe, water and :':lewer improvements
in Lely Resort Phase Six, all authorize the Cle;:k to release the
maintenance security.
BE I':' FURTHER RESOLVED AND ORDERED that the County accept the
future maintenance and other attendant costs for the roadway,
drainage, water and sewer improvements that art not required to be
maintained by the homeowners association.
This Resolution adopted after motion, seco~'Jd and majority vote
favoring same.
