RESOLUTION no. 95 -387
RE~OLUTION AUTHORIZING FINAL ACCEPTANCE OF THOSE
ROADWAY, DRAINAGE, WATER AND SEWER IMPROVEMENTS IN
SPINNAKER POINTE AT WINDSTAR, RELEASE OF THE
MAlNTENANCE SECURITY, AND ACCEPTING THE MAINTENANCE
RE~PONSIBILITY FOR THE ROADWAY, DRAINAGE, WATER AND
SErER IMPROVEMENTS THAT ARE NOT REQUIF..ED TO BE
MAINTAINED BY THE HOMEOWNERS ASSOCIATION.
WHEREAf', the Board of County Commissioners of Collier County,
Florida, on September 13, 1993, approved the plat of Spinnaker
pointe at Windstar for recording; and
WHEREAF, the developer has constructed and maintained the
roadway, dr"inage, water anti sewer improvement! in accordance with
the approved plans and spec~fications and as rEquired by the Land
Development Code (Collier CCiunty Ordinance No. 91-102, as amended);
and the uti~ities Standards and Procedures Ordjnance (Collier
County OrdiJ..ance No. 88-76, as amended), and
WHEREAf;, the developer has now requested final acceptance of
the roadway, drainage, watet. and sewer improveI'ants and release of
his maintenance security; and
WHEREAS, the Compliance Services Section of Development
Services Department has inspected the roadway, drainage, water and
sewer improvements and is recommending acceptan.::e of said
facilities.

NOW, THEREFORE, BE IT 1: ESOLVED BY THE BOA}') OF COUNTY
COMMISSIONERS OF COLLIER CO')~TY, FLORIDA, that final acceptance be
granted for those roadway, ..~~inage, water and sewer improvements
in Spinnaker pointe at Wind: tar, and authorize the Clerk to release
the maintena;~ce security.
BE IT FURTHER RESOLVED AND ORDERED that the County accept the
future maintenance and other attendant costs fr~ the roadway,
drainage, water and sewer improvements that arc not required to be
maintained by the homeowners association.
