Tamiami Trail Naples, FL 34112 RE: Consideration of 5 Year RLSA Plan Dear Chair Fiala and Commissioners: We write to comment on the Rural Land Stewardship Area (RLSA) Review Committee's Phase 2 report of April 21, 2009, which we understand you will consider at an upcoming commission meeting next week. We believe it is important to follow the good recommendation recently made by your Planning Commission that the number of development credits be limited to the previously authorized 315,000, and that as feasible, the County considers the reallocation of such credits. Our considerations are explained below, Since 2002, we have followed your innovative work as well as the RLSA Committee in adopting and implementing a development strategy within the Immokalee area that would not result in an increase in the already allowed dwelling units in favor of a clustered approach that protects agriculture and habitats, Our understanding was that the adopted program overcame the existing sprawl density pattern of one dwelling unit/5 acres and instead with all parties approval, resulted in slightly more than 134,000 credits in the compact, rural development pattern on about 17,000 acres within this large 200,000 acre area. In fact, we recognized this plan for one of our prestigious Better Community Awards for 2005, and have since been pleased with the success in making Ave Maria an integral part of this process. We continued to support the plan as it evolved even though the number of credits ultimately has more than doubled to approximately 315,000 credits. We were somewhat surprised to learn that the RLSA Committee over the last several months has developed a proposal to add even more credits, so that the total authorized would be about 400,000 credits, or another 89,000. In addition, we understand that no cap is proposed on the future consideration for what could become additional credits. While we appreciate the discussion of finding ways to reduce these credits, either by purchase through local, state or federal revenues and/or grants, this is likely to directly affect taxpayers that are already concerned about their financial situation. The need justification for the additional development credits has escaped us as it apparently did DCA when it commented to this effect in its correspondence of June 16, 2008. This past summer, we did comment to the RLSA Committee on June 29, 2008, about several issues that concerned us, and the biggest then, and remains today, the addition of more development credits. We completely understand the need for development patterns that are as dense and as compact as possible, but there must be reasonable consideration made for the type and location of infrastructure needed. I am a planner, former new town developer/builder, and policy advisor to local, state and federal government - with 20 years experience in Smart Growth, sustainable development, and New Urbanism, including extensive work in South Florida - and have just completed significant national research publications comparing smart growth and conventional development's impacts and potential. I am both impressed by the overall RLSA program and concerned about some of the proposed changes. The Collier County Planning Commission's recommendations to amend the RLSA report as a planning document should be implemented. They have reviewed the RLSA Review Committee's report with both attention to detail and a broad planning policy overview. While they endorse the majority of the RLSA Committee's report, the CCPC's concerns are specific and sensible, and will ensure the refined program will deliver on its original intent. This includes a cap on credits at 315,000 (rather than on acreage) and a variety of other minor enhancements. It is generally good public policy to rely on a planning commission's overall review and refinement of documents that affect growth and infrastructure policies, and especially true in this case - where it appears that the RLSA Review Committee's Report is based largely on recommendations by the major landowners and their consultant's calculations. There is no proven need for wholesale revisions as requested by the landowners. The RLSA is an innovative, award,winning program that is working well but not yet fully tested, Despite the understandable landowner interest in adding to their credit bank, public efforts should focus on how best to implement the existing program. There is no reason to rush. Both the public sector and private landowners have a long-term interest in maintaining value, and are best served by a thoughtful, long-term approach. Rather than moving forward with a special GMP amendment cycle, the RLSA amendments should move through the regular cycle, at standard timing, or be included in the EAR amendment process. Either approach would allow for current buildout scenario and infrastructure cost estimates to be completed, and for the proposed amendments to be reviewed in light of that critical information. Much has changed in the last five years. There have been substantive national and local changes in markets (even before the recent economic downturn). SW Florida is one of the nation's most impacted housing markets; the President chose SW Florida to declare the 'end of sprawl,' recognizing we can no longer afford to provide and maintain such expansive infrastructure. The recent $50 million bond issue to improve, among other projects, Oil Well Road at public cost is just one example of what the county will face in the future. The housing market is shifting toward even more compact development patterns, and with extreme fluctuations in fuel prices, people are asking for more transportation choices, including transit (which requires a minimum of 6 to 7 units/acre for efficient service). These assumptions are out-of- synch with the award-winning, forward-thinking RLSA resource-protection plan. With major shifts likely in the market, especially the key aging demographic, it is ill-advised to lock in a specific acreage cap when there could be a market surge toward even more compact development patterns - consuming less land and requiring less public service cost. Infrastructure costs, especially long-term maintenance, are rising and unknown without a thorough buildout scenario. With growing national awareness of the full longtime costs to build and maintain our public infrastructure - roads, water, sewer, utilities, schools, parks, emergency services -local governments have realized they cannot afford to continue permitting and funding sprawling, expansive systems without understanding the full long term costs. State and federal agencies have indicated they will not be able to continue funding and repairing even the infrastructure already in place (the national infrastructure repair bill is estimated to be in the trillions of dollars). Since the County already has a process underway to develop buildout scenarios and estimated costs, it would be unwise to rush into adding the potential for more sprawling development before fully understanding its impacts. (US DOT and HUD are initiating joint programs to assist communities in developing such scenario analysis). It will be more effective to cap credits than to cap acreage. The current credit structure was carefully worked out, and is working. The credit formulas need further real-world testing as they are used over time. There are more than enough credits already in the system for a full testing and evaluation period, without the need for wholesale revisions or a windfall bonanza of additional credits. A rapid influx of a large percentage of credits into the system will likely devalue the existing credits, akin to current concerns about just 'printing money' in the global economic system. A credit cap would help establish value for the existing credits, encouraging their use, and may help the smaller landowners to benefit from the program. A wholesale input of new credits would tend to deflate their value. An acreage cap would ensure the entire available area would be built out, whereas a credit cap, coupled with the changing market, may yield the same value to investors and landowners while building on less land and protecting more habitat and agricultural land, especially if restoration credits are fully utilized. Per ICF economist Barry Galef: "Assuming strong development demand, adding more potential credits would mean either excessive acres of development, an unfair and potentially disruptive devaluation of existing credits, or a separate cap on developed acres. A separate acreage cap would be likely to drive the value of credits toward zero, and could encourage wasteful "rent-seeking" if not implemented carefully. Thus, making excessive credits possible cannot equitably and efficiently achieve the Commission's environmental and land use goals." (See analysis by Gale! under separate cover) A thorough, independent analysis of the credit calculations should be conducted. While the calculations performed by the landowners' consultant may be accurate, the program seems overly dependent on a single source of 'credit math' - especially with the recent jump from an initial 134,000 credits to an estimated 315,000 credits., and the current proposal's potential for tens of thousands more credits to be available. A Florida university team could perform such an objective analysis, with the additional benefit of training young planners to understand and widely apply the system in the future. The landowners' consultant should provide their data and methodology to assist in this review, which could be conducted in parallel with a standard GMP amendment cycle. I hold a Ph.D. in Economics from Yale University, and have been working as a consultant to the US EPA and other government and private clients for almost 30 years. Before that I taught economics for several years at the State University of New York at Albany, and (as a graduate student) at Yale. Much of my work has centered on the use of cap-and-trade systems to reduce the cost of controlling pollution in various industries. I have worked on market-based programs to cut hydrocarbons from light-duty vehicles, NOx and particulate matter from large diesels, carbon from cars and trucks in Canada, greenhouse gases from Ireland and the rest of the European Union. In the area of stationary sources I have played important roles in support ofEPA as it developed cap-and-trade programs to cut S02, NOx, mercury, and carbon from power plants and industrial boilers. This work has given me an unusually deep understanding of the operation of trading systems aimed at environmental protection, and the problems that can crop up if they are not designed carefully. I was asked to evaluate the Collier County development credit program. At issue is the raising of the nwnber of credits that can be created by landowners and then traded for the right to develop other land to a relatively high density. Assuming strong development demand, I find that adding more potential credits would mean either excessive acres of development, an unfair and potentially disruptive devaluation of existing credits, or a separate cap on developed acres. A separate acreage cap would be likely to drive the value of credits toward zero, and could encourage wasteful "rent-seeking" if not implemented carefully. Thus, making excessive credits possible cannot equitably and efficiently achieve its goals. Brief Explanation of the Situation The Rural Lands Stewardship Area (RLSA) is a large portion of Collier County where about 36,000 dwellings were authorized at low density (no more than one dwelling on each five acres). A program was introduced to encourage the concentration of development within a fraction of the area. The program was intended to work through the transference of development rights from some of the acres to a limited portion of the RLSA where higher densities would be pennitted. This transference would be mediated through a system of tradable credits, awarded to landowners willing to accept limits and obligations more severe than the existing l-per-5 limit. The ultimate size of the densely developed portion of the RLSA will depend on several factors: limits on the maximum number of credits that can be created; decisions by landowners to take the steps to create the credits; decisions by developers to acquire and use the credits; the number of credits needed to develop an acre of land to a high density (the "credit exchange ratio"), and any limit on the acreage of densely developed land. At issue is raising the potential number of credits that can be created. Before deciding this issue, we should examine its consequences, which can be measured in several ways: the ultimate footprint of developed land; the quality ofthe undeveloped land (e.g., agricultural use, restoration, panther corridors); fairness to ~ C~ landowners who currently hold credits in hopes of selling them; and efficiency. In the sections that follow, I show that better consequences are likely to flow from leaving the program unchanged Consideration of Distinct Cases As mentioned above, the program's consequences will depend 011 several distinct and unpredictable factors, including demand for dense development, as well as the particular policy options used program's effects. The sections below examine cases of slow growth, rapid growth with no development cap, and rapid growth with a cap on developed acres. Slow Growth First, if demand for densely developed property remains low for a very long time (in line with current population projections), the credits already authorized under the program could exceed the demand for decades. Though the credits may be sold, their potential market value would be close to zero, and it is unlikely that a viable market would develop under those conditions. The dynamics of this potential market can be illustrated by constructing what are essentially supply and demand curves, which can help provide insights into different policies and scenarios even if a true market never develops. The current situation is shown by the intersection of a downward-sloping line indicating the current demand for credits and a very low and almost horizontal portion of a curve indicating the supply of credits. The demand is well to the left on the graph; because of slow population gro\\1h and low real estate demand, few acres are being developed, which means that few credits are needed. In contrast, large numbers of credits already exist - many of them cost almost nothing to create, and so are easily available. If credits were actively bought and sold in this market, their price would tend to settle where the supply and demand curves cross - and that would be at a very low price (Pl) because the credits availahle at a price close to zero easily satisty the demand. The dashed credit supply curve to the right of the current supply curve shows graphically what we can expect ifmore credits are added to the system: though at any given value for the credits, more can be available, the equilibrium would probably not change at all: if all ofthe current demand for credits can already be met at a price close to zero, the additional credits would tlnd no takers in the near term. Eventually, of course, the demand for development, and hence the demand for credits, will presumably t~ . . increase. That would shift the demand curve to the right, until the added credits would eventually mean a difference in the equilibrium value of the credits. But because it appears that it will be decades before the market equilibrium could be affected by adding credits, making changes in the program now will not bear any fruit for a very long time. In economic tenns, expending effort to change the program now instead decades in the future has a cost, but no benefit - and is therefore wasteful. Rapid Growth without a Development Cap If population growth speeds up enough, though, adding credits can be important even in the near tenn. The effects of adding credits would then depend on the specifics ofthe policy. If the cap on credit creation is relaxed, and there are no other changes in the program, the total developed area could easily exceed 45,000 acres and limit (physically) the undeveloped zone that could provide environmental benefits. That possibility is shown in Exhibit 2. The potential price of credits could be well above zero (P2 on the graph), giving an incentive for landowners to undertake some beneficial actions - but at the cost of an excessive extent of development that could undo any environmental benefits that the program might be able to provide. Rapid Growth with a Separate Cap on Developed Acres To avoid over-development, the Commission could impose a separate acreage cap on densely developed land. That option is illustrated by the heavy vertical line in Exhibit 3. It would add an additional constraint to the system, with potentially unwanted effects. The constraint would create a large value for developers who obtained the right to develop within that acreage cap, as shown by the line P4. But that value would attach to the rights to use the transferable credits, not to the credits themselves. The credits would now be in excess supply because not all of them could be used within the acreage cap, and their value would be driven down (to P3 in Exhibit 3) Ifthe right to transfer credits and develop acres were approved on a tirst-come-first-served basis up to the acreage limit, developers and landowners could be expected to rush through their plans, aborting the .r 1 C~ creation of some of the potential credits and possibly leaving some fraction of the existing credits worthless. The "land rush" encouraged by this approach is an example of the inemcient behavior economists call "rent seeking." as speed would take precedence over value. The loss of some potential credits would mean that the Commission has lost some control over the path of development, losing some environmental benelits in the process. Furthermore, any existing credits that could not be used would represent unfairness to their holders. But setting up this parallel system would be cumbersome, and would leave the other problems unabated. Two overlapping cap-and-trade systems generally drive the value of credits in the program that is not "binding" down toward zero (P3 on the graph), again, with the loss of some control over the course of development and unfairness toward some credit holders. Devaluation of Credits Yet another way to limit the footprint of development while adding credits and maintaining the some value for those credits would be to devalue them. Mathematically, it might be possible to find a new exchange ratio - higher than the current 8-to-1 level -. between credits and acres of dense development that would reconcile the total number of credits with a desired limit on total development. The etTect of that approach would be like suddenly devaluing or inflating a currency: depending on the specilics, it could unfairly hurt existing credit holders, create uncertainty over future values, and/or lead to inemcient development. A one- time, up-front change in the ratio might be the least disruptive way to do this: though some existing credit holders who made decisions based on the original ratio would lose some cfthe value they had counted on receiving, everyone involved could at least make their subsequent plans without uncertainty. Unfortunately, it might not be possible to know up-front what the correct ratio would be, because of uncertainty about the maximum number of credits that could be generated once the rules of the program have been modified to allow for more credits. If adjustments in the exchange ratio have to be made piecemeaL and at unexpected points in time, then the program takes on the characteristics of an economy with unexpected and variable inllation. Uncertainty reigns, planning becomes difficult, and growth can be crippled \vhen currency is subject to unpredictable changes. C~ Conclusion As seen above, adding the potential for more credits to a system that would already allow the dense development of close to the maximum desirable acreage of the RLSA cannot be accomplished without compromising the goals of the program. The precise consequences of adding credits would depend on numerous factors. It seems clear, though, that changing the program would either .:. have no immediate effects other than administrative costs, .:. lead to overdevelopment, .:. destroy the value of credits through a potentially wasteful parallel development cap, or .:. devalue the credits in ways likely to engender uncertainty and inhibit growth. Ifit is deemed necessary to change the mix of credits (e.g., toward more restoration or agricultural use) the only approach that would not hurt existing credit holders would be to leave the total cap in place while changing the rules for creating new credits. That would be the equivalent of capping the credits at the current maximum level of315,000 while redistributing them to best protect the important qualities of the RLSA. Attachments (2) RESOLUTION 2009-100 RESOLUTION OF THE COLLIER COUNTY BOARD OF COMMISSIONERS IN SUPPORT OF SUBMISSION OF HIGH PRIORITY PROJECTS FOR CONSIDERATION OF FUNDING IN THE UPCOMING UNITED STATES SURFACE TRANSPORTATION BILL TO BE COMMONLY KNOWN AS "MOVING AHEAD FOR PROGRESS IN THE 21 ST CENTURY." WHEREAS, the u.s. House of Representatives' Committee on Transportation and Infrastructure (the "Committee") is in the process of drafting new surface transportation authorization legislation to replace the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) (P.L. 109-59), which expires on September 30, 2009, to be called Moving Ahead for Progress in the 21 st Century (commonly referred to as "MAP-21;" and WHEREAS, the Committee is seeking to ensure that the surface transportation needs of all communities represented by Congress are adequately served, a small percentage of the overall investment funds available under MAP-21 will be dedicated for House Member-designated, High Priority Projects ("HPPs"); and WHEREAS, HPP's refer to worthwhile projects critical to a House member's district that will promote the diverse transportation needs for which funding will be available under MAP-2] ; and WHEREAS, all HPP projects submitted for consideration must meet the eligibility criteria under Title 23 (Highways) and Chapter 53 of Title 49 (Public Transit) of the United States Code to comply with highway and transit program objectives; and WHEREAS, all HPP projects submitted by House Members must include specific information on the type, location, total cost, percentage of total cost that the request would finance, and the benefits of the proposed project; and WHEREAS, each House Member offering HPPs for consideration shall include at least one letter of support from the affected local government agency that will benefit from the project; and WHEREAS, the deadline to submit proposed HPPs to Collier County's United States Representatives, Mario Diaz-Balart and Connie Mack, for consideration under MAP-21 is April 24, 2009; and WHEREAS, recognizing extenuating circumstances associated with the short timeline for Federal consideration of the Collier County area's proposed HPPs and being desirous of fair consideration of said projects. 1 NOW, THEREFORE, BE IT RESOLVED by the Collier County Board of County Commissioners that: 1. Collier County's High Priority Projects for submission of funding under the new surface transportation authorization legislation commonly known as MAP-2 I shall consist of the following five road projects: a. 1-75 and Everglades Interchange b. 1-75 and Collier Boulevard Interchange c. SR 29 Bypass incuding SR 82/SR29 Intersection d. SR-951 and USAI Interchange e. Camp Keais Roadway Improvements Funding for a sixth transportation project, involving the Immokalee Airport, will not be submitted for funding under MAP-21 but rather additional funding will be sought through Federal Aviation Administration appropriations. 2. Its Chairman is hereby authorized to prepare a letter of support in favor of the County's HPPs to Congressmen Mario Diaz-Balart and Connie Mack that includes any and all supporting documentation required to sufficiently identify all five of the HPPs for consideration consistent with the criteria established by the Committee on Transportation and Infrastructure. 3. Its Chairman is further hereby authorized to revise and execute any and all documents necessary to seek funding for the county's high priority transportation projects under the MAP-2 I authorization legislation, including but not limited to executing grant applications, assurances, certifications, and accepting any such funds received on behalf of the County. This Resolution PASSED and duly adopted by the Collier County Board of Commissioners after majority vote. on this 21st day of April, 2009. .'!
